Marginal note:Commissioner may institute prosecution

  •  (1) If the Commissioner believes on reasonable grounds that an offence under this Act has been committed — or that there has been a conspiracy to commit or an attempt to commit an offence under this Act or that a person or entity has been an accessory after the fact, or has counselled, in relation to an offence under this Act — the Commissioner may institute a prosecution or cause one to be instituted.

    (2) The prosecution is instituted by the laying of an information in writing and under oath before a justice, as defined in section 2 of the Criminal Code.
