Manitoba Hog Order

C.R.C., c. 154

AGRICULTURAL PRODUCTS MARKETING ACT

Order Granting Authority to Regulate the Marketing in Interprovincial and Export Trade of Hogs Produced in Manitoba

Short Title

 This Order may be cited as the Manitoba Hog Order.

Interpretation

 In this Order,

Act

Act means The Natural Products Marketing Act of Manitoba, C.C.S.M., c. N20; (Loi)

Commodity Board

Commodity Board[Repealed, SOR/97-422, s. 1]

hog

hog means a member of the species Sus Scrofa L. (domestic pig) of any kind, grade or class; (porc)

Plan

Plan means any plan for the marketing of hogs, established and amended from time to time, pursuant to the Act; (Plan)

Producer Board

Producer Board means the Manitoba Pork est., continued pursuant to subsection 3(1) of the Manitoba Hog Producers’ Marketing Plan Regulation made under the Act. (organisation de producteurs)

Interprovincial and Export Trade

 The Producer Board is authorized to regulate the marketing of hogs in interprovincial and export trade and for such purposes may, with respect to persons and property situated within the Province of Manitoba, exercise all or any powers like the powers exercisable by it in relation to the marketing of hogs locally within that Province under the Act and the Plan.

Levies

 The Producer Board is authorized, in relation to the powers granted to it by section 3 with respect to the marketing of hogs in interprovincial and export trade, to make orders fixing, imposing and collecting levies or charges from persons described in section 3 who are engaged in the production or marketing of hogs and for such purpose classifying such persons into groups and fixing levies or charges payable by the members of the different groups in different amounts; and the Producer Board may use such levies or charges for its purposes, including the creation of reserves, the payment of expenses and losses resulting from the sale or disposal of hogs and the equalization or adjustment among producers of hogs of moneys realized from the sale thereof during such period or periods of time as it may determine.
