Ontario Cream Producers’ Marketing Levies Order

AGRICULTURAL PRODUCTS MARKETING ACT

Order Providing for the Fixing, Imposing and Collecting of Levies from Certain Cream Producers in Ontario

Short Title

 This Order may be cited as the Ontario Cream Producers’ Marketing Levies Order.

Interpretation

 In this Order,

Commodity Board

Commodity Board means The Ontario Cream Producers’ Marketing Board established by Order of the Lieutenant Governor in Council of Ontario pursuant to The Milk Act of Ontario; (Office de commercialisation)

cream

cream means cream delivered to a plant for manufacture into creamery butter; (crème)

plant

plant means a cheese factory, concentrated milk plant, cream receiving station, creamery, dairy or milk receiving station; (fabrique)

producer

producer means a producer engaged in the production of cream; (producteur)

quota

quota means a quota in pounds of milk-fat fixed and allotted to a producer by the Commodity Board in relation to the volume of sales of cream by all producers. (contingent)

Levies

  •  (1) Every producer shall pay to the Commodity Board, in addition to the licence fees set out under the Ontario Cream Producers’ Marketing-for-Processing Plan, levies at the rate of $1 for each pound of butterfat sold or delivered by him to a plant that is in excess of the quota fixed and allotted to him.

  • (2) The plant operator shall deduct from the moneys payable to a producer all levies payable by the producer to the Commodity Board under subsection (1) and shall pay such levies to the Commodity Board not later than the 15th day of the month following the month in which the levies were deducted.
