Governor in Council Authority Delegation Order
C.R.C., c. 355
ARCTIC WATERS POLLUTION PREVENTION ACT
Order Delegating Power and Authority Under Section 26 of the Arctic Waters Pollution Prevention Act
Short Title
1 This Order may be cited as the Governor in Council Authority Delegation Order.
Delegation
2 His Excellency the Governor General in Council hereby
(a) delegates to the Minister of Transport the power and authority to do the acts or things the Governor in Council is directed or empowered to do under the following provisions of the Arctic Waters Pollution Prevention Act, namely, subsection 5(2), subsection 6(2) in so far as the condition described therein results from a deposit of waste from a ship, paragraph 8(1)(d) and subsections 13(1) and 14(1); and
(b) delegates to
(i) the Minister of Indian Affairs and Northern Development, in relation to those areas of the Canadian arctic in respect of which he has administrative responsibility for the natural resources therein, and
(ii) the Minister of Energy, Mines and Resources, in relation to those areas of the Canadian arctic in respect of which he has administrative responsibility for the natural resources therein,
the power and authority to do the acts or things the Governor in Council is directed or empowered to do under the following provisions of the said Act, namely, subsection 5(1), subsection 6(2) in so far as the condition therein does not result from a deposit of waste from a ship, paragraphs 8(1)(a), (b) and (c), section 10 and subsection 14(1) except with respect to the designation of pollution prevention officers with powers greater than those set out in subsections 15(1) and (2).
