AERONAUTICS ACT

Regulations Respecting Zoning at London Airport

Short Title

 These Regulations may be cited as the London Airport Zoning Regulations.

Interpretation

 In these Regulations,

airport

airport means London Airport, City of London, in the Province of Ontario; (aéroport)

airport reference point

airport reference point means the point determined in the manner set out in Part I of the schedule; (point de repère de l’aéroport)

approach surface

approach surface means an imaginary inclined plane extending upward and outward from each end of a strip along and at right angles to the projected centre line thereof, which approach surface is more particularly described in Part III of the schedule; (surface d’approche)

Minister

Minister means the Minister of Transport; (ministre)

outer surface

outer surface means an imaginary surface located above and in the immediate vicinity of the airport, which outer surface is more particularly described in Part IV of the schedule; (surface extérieure)

strip

strip means the rectangular portion of the landing area of the airport, including the runway prepared for the take-off and landing of aircraft in a particular direction, which strip is more particularly described in Part V of the schedule; (bande)

transitional surface

transitional surface means an imaginary inclined plane extending upward and outward from the lateral limits of a strip and its approach surface, which transitional surface is more particularly described in Part VI of the schedule. (surface de transition)

 For the purposes of these Regulations, the airport reference point is deemed to be 898 feet above sea level.

Application

 These Regulations apply to all the lands, including public road allowances, adjacent to or in the vicinity of the airport, the outer limits of which lands are described in Part II of the schedule, other than such lands as from time to time form part of the airport.

General

 No person shall erect or construct, on any land to which these Regulations apply, any building, structure or object or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at the location of that point any of the surfaces hereinafter set out that project immediately over and above the surface of the land at that location, namely,

  • (a) the approach surfaces;

  • (b) the outer surfaces; or

  • (c) the transitional surfaces.

Natural Growth

 Where an object of natural growth on any land to which these Regulations apply exceeds in elevation any of the surfaces referred to in section 5, the Minister may make a direction that the owner or occupier of the land on which that object is growing remove the excessive growth.

PART IAirport Reference Point

Being a point at the intersection of a line drawn parallel to and distant 250 feet measured northwesterly at right angles from the centre line of runway 05-23 and a line drawn parallel to and distant 600 feet measured northeasterly at right angles from the centre line of runway 14-32.

PART IIDescription of Outer Limits of Lands

COMMENCING at the northeasterly corner of Lot 6, in Concession 1 North of the River Thames, in the Township of North Dorchester; THENCE, southerly along the eastern boundary of said Lot 6 to the southeasterly corner of the said Lot; THENCE, westerly along the southern boundary of Lot 6 to the southwesterly corner of the said Lot; THENCE, southerly in a straight line across the allowance for road between Concessions 1 and 2 North of the River Thames, in the said Township, to the northeasterly corner of Lot 5, in Concession 2 North of the River Thames; THENCE, southerly along the eastern boundary of said Lot 5 to the intersection thereof with a line drawn parallel with the southern limit of the said allowance for road and perpendicularly distant 3,000 feet measured southerly therefrom; THENCE westerly along the said parallel line across Lots 5, 4 and 3, in the said Concession 2, to the intersection thereof with the western boundary of Lot 3, in the said Concession 2; THENCE, northerly along the western boundary of said Lot 3 to the northwestern corner of the said Lot; THENCE, northerly in a straight line across the said allowance for road to the southeasterly corner of Lot 2, in Concession 1 North of the River Thames; THENCE westerly along the southern boundary of Lot 2 and Lot 1, in the said Concession, to the southwesterly corner of said Lot 1; PART IIIDescription of Each Approach Surface

Being a surface abutting each end of the strips associated with runways 05-23, 08-26 and 14-32 and more particularly described as follows:

  • (a) a surface abutting the end of the strip associated with runway approach 05 consisting of an inclined plane having a ratio of one (1) foot measured vertically to twenty (20) feet measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip three hundred and twenty-five (325) feet measured vertically above the elevation at the end of the strip and six thousand five hundred (6,500) feet measured horizontally from the end of the strip, the outer ends of the imaginary horizontal line being eight hundred (800) feet from the projected centre line,

  • (b) a surface abutting the end of the strip associated with runway approach 08 consisting of an inclined plane having a ratio of one (1) foot measured vertically to fifty (50) feet measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip two hundred (200) feet measured vertically above the elevation at the end of the strip and ten thousand (10,000) feet measured horizontally from the end of the strip, the outer ends of the imaginary horizontal line being two thousand (2,000) feet from the projected centre line,

  • (c) a surface abutting the end of the strip associated with runway approach 14 consisting of an inclined plane having a ratio of one (1) foot measured vertically to fifty (50) feet measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip two hundred (200) feet measured vertically above the elevation at the end of the strip and ten thousand (10,000) feet measured horizontally from the end of the strip, the outer ends of the imaginary horizontal line being two thousand (2,000) feet from the projected centre line,

  • (d) a surface abutting the end of the strip associated with runway approach 23 consisting of an inclined plane having a ratio of one (1) foot measured vertically to twenty (20) feet measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip three hundred and twenty-five (325) feet measured vertically above the elevation at the end of the strip and six thousand five hundred (6,500) feet measured horizontally from the end of the strip, the outer ends of the imaginary horizontal line being eight hundred (800) feet from the projected centre line,

  • (e) a surface abutting the end of the strip associated with runway approach 26 consisting of an inclined plane having a ratio of one (1) foot measured vertically to fifty (50) feet measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip two hundred (200) feet measured vertically above the elevation at the end of the strip and ten thousand (10,000) feet measured horizontally from the end of the strip, the outer ends of the imaginary horizontal line being two thousand (2,000) feet from the projected centre line, and

  • (f) a surface abutting the end of the strip associated with runway approach 32 consisting of an inclined plane having a ratio of one (1) foot measured vertically to fifty (50) feet measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip two hundred (200) feet measured vertically above the elevation at the end of the strip and ten thousand (10,000) feet measured horizontally from the end of the strip, the outer ends of the imaginary horizontal line being two thousand (2,000) feet from the projected centre line,

which approach surfaces are shown on Department of Transport Plan No. T2868, dated October 1, 1974.

PART IVDescription of the Outer Surface

Being an imaginary surface consisting of

  • (a) a common plane established at a constant elevation of one hundred and fifty (150) feet above the elevation of the airport reference point, and

  • (b) where the common plane described in paragraph (a) is less than thirty (30) feet above the surface of the ground, an imaginary surface located thirty (30) feet above the surface of the ground,

which outer surface is shown on Department of Transport Plan No. T2868, dated October 1, 1974.

PART VDescription of Each Strip

Each strip is described as follows:

  • (a) the strip associated with runway 05-23 is three hundred (300) feet in width, one hundred and fifty (150) feet being on each side of the centre line of the runway, and three thousand five hundred and seventy-four (3,574) feet in length,

  • (b) the strip associated with runway 08-26 is one thousand two hundred (1,200) feet in width, six hundred (600) feet being on each side of the centre line of the runway, and six thousand eight hundred (6,800) feet in length, and

  • (c) the strip associated with runway 14-32 is one thousand (1,000) feet in width, five hundred (500) feet being on each side of the centre line of the runway, and nine thousand three hundred (9,300) feet in length,

which strips are shown on Department of Transport Plan No. T2868, dated October 1, 1974.

PART VIDescription of Each Transitional Surface

Being a surface consisting of an inclined plane having a ratio of one (1) foot measured vertically to seven (7) feet measured horizontally at right angles to the centre line and centre line produced of each strip extending upward and outward from the lateral limits of each strip and its approach surfaces to an intersection with the outer surface or another transitional surface of an adjoining strip, all as shown on Department of Transport Plan No. T2868, dated October 1, 1974.
