Her Excellency the Governor General in Council, on the recommendation of the Minister of Indian Affairs and Northern Development, pursuant to paragraph 23(a) of the Territorial Lands Act, hereby makes the annexed Order Respecting the Withdrawal from Disposal of Certain Lands in the Northwest Territories (Sahoyúé — ʔehdacho (Grizzly Bear Mountain and Scented Grass Hills), National Historic Site, N.W.T.).

Purpose

 The purpose of this Order is to withdraw certain lands from disposal to facilitate the establishment of the proposed Sahoyúé — ?ehdacho (sow-you/eh-dah-cho) (Grizzly Bear Mountain and Scented Grass Hills), National Historic Site in the Sahtu Region of the Northwest Territories.

Lands Withdrawn from Disposal

 Subject to sections 3 and 4, the tracts of territorial lands set out in Schedules 1 to 5, including the surface and subsurface rights to the lands, are withdrawn from disposal for the period beginning on the day on which this Order is made and ending on November 30, 2010.

Exceptions

 Section 2 does not apply to the disposition of substances or materials under the Territorial Quarrying Regulations.

Existing Rights and Interests

 For greater certainty, section 2 does not apply to

  • (a) the locating of a mineral claim by the holder of a prospecting permit granted before the day on which this Order is made;

  • (b) the recording of a mineral claim that is referred to in paragraph (a) or that was located before the day on which this Order is made;

  • (c) the granting of a lease under the Canada Mining Regulations to a person with a recorded claim if the lease covers an area within the recorded claim;

  • (d) the issuance of a significant discovery licence under the Canada Petroleum Resources Act to a holder of an exploration licence that was issued before the day on which this Order is made if the significant discovery licence covers an area subject to the exploration licence;

  • (e) the issuance of a production licence under the Canada Petroleum Resources Act to a holder of a significant discovery licence that is referred to in paragraph (d) if the production licence covers an area subject to the significant discovery licence;

  • (f) the issuance of a production licence under the Canada Petroleum Resources Act to a holder of an exploration licence or a significant discovery licence that was issued before the day on which this Order is made if the production licence covers an area subject to the exploration licence or the significant discovery licence;

  • (g) the granting of a surface lease under the Territorial Lands Act to a holder of a recorded claim under the Canada Mining Regulations or of an interest under the Canada Petroleum Resources Act if the surface lease is required to allow the holder to exercise rights under the claim or interest; or

  • (h) the renewal of an interest.

Repeal

 The Order Respecting the Withdrawal from Disposal of Certain Lands in the Northwest Territories (Sahyoue/Edacho (Grizzly Bear Mountain and Scented Grass Hills), N.W.T.)Footnote 1 is repealed.

Edition 1 of the unnamed NTS map sheet number 96 H/13, produced at a scale of 1:50 000;

Edition 1 of the unnamed NTS map sheet number 96 H/14, produced at a scale of 1:50 000;

Edition 1 of the Etacho Point NTS map sheet number 96 I/3, produced at a scale of 1:50 000;

Edition 1 of the unnamed NTS map sheet number 96 I/4, produced at a scale of 1:50 000;

Edition 1 of the unnamed NTS map sheet number 96 J/1, produced at a scale of 1:50 000;

Edition 1 of the unnamed NTS map sheet number 96 J/2, produced at a scale of 1:50 000;

Commencing at the northerly corner of Sahtu lands parcel 63, being the point of intersection of the south bank of an unnamed stream with the east bank of Mackintosh Bay of Great Bear Lake, at approximate latitude 66°08′18″N and approximate longitude 123°00′10″W;

Thence due west to the water’s edge of Great Bear Lake;

Thence in a clockwise direction, generally northerly, easterly, southerly and westerly along the water’s edge of Mackintosh Bay, Smith Arm, Douglas Bay and Deerpass Bay of Great Bear Lake to a point being due east of an easterly corner of Sahtu lands parcel 63, at approximate latitude 65°59′45″N and approximate longitude 122°27′38″W;

Thence due west to said Sahtu lands parcel corner, being the intersection of the south bank of an unnamed stream with the easterly bank of Deerpass Bay of Great Bear Lake, at approximate latitude 65°59′45″N and approximate longitude 122°27′38″W;

Thence continuing along the northerly boundary of Sahtu lands parcel 63 to the point of commencement.

Said parcel containing approximately 1 975 km2 (763 square miles).

Edition 1 of the unnamed NTS map sheet number 96 G/15, produced at a scale of 1:50 000;

Edition 1 of the Kokeragi Point NTS map sheet number 96 G/16, produced at a scale of 1:50 000;

Edition 1 of the unnamed NTS map sheet number 96 J/2, produced at a scale of 1:50 000;

Edition 1 of the Goodfellow Point NTS map sheet number 96 J/3, produced at a scale of 1:50 000;

Commencing at the northerly corner of Sahtu lands parcel 63, being the point of intersection of the south bank of an unnamed stream with the east bank of Mackintosh Bay of Great Bear Lake, at approximate latitude 66°08′18″N and approximate longitude 123°00′10″W;

Thence in a clockwise direction easterly, and continuing along the boundary of Sahtu lands parcel 63, past Deerpass Bay in Great Bear Lake and continuing along said boundary to a point on the Sahtu lands parcel 63 boundary, being the intersection of the northeast limit of a seismic line with the easterly bank of an unnamed stream, at approximate latitude 65°58′40″N and approximate longitude 123°20′29″W;

Thence due north to a point on the boundary of Sahtu lands parcel 63, being the bank of Smith Arm of Great Bear Lake;

Thence easterly and northerly along the boundary to the point of commencement.

Said parcel containing approximately 675 km2 (261 square miles).

Commencing at the northerly corner of Sahtu lands parcel 76, being the point of intersection of the south bank of Keith Arm of Great Bear Lake with the southwest bank of an unnamed stream, at approximate latitude 65°00′22″N and approximate longitude 121°48′02″W;

Thence due west to the water’s edge of Great Bear Lake;

Thence in a clockwise direction northerly, northeasterly, easterly, southwesterly and southerly along the water’s edge of Keith Arm and McVicar Arm of Great Bear Lake to a point being due east of the northeasterly corner of Sahtu lands parcel 76, at approximate latitude 65°01′16″N and approximate longitude 120°58′54″W;

Thence due west, to the northeasterly corner of Sahtu lands parcel 76, being the intersection of the west bank of McVicar Arm of Great Bear Lake and the south bank of an unnamed stream, at approximate latitude 65°01′16″N and approximate longitude 120°58′54″W;

Thence continuing in a clockwise direction along the northerly boundary of Sahtu lands parcel 76 to the point of commencement.

Excluding the surface of Sahtu Specific sites F40, F41, F43 and F44.

Said parcel containing approximately 2 470 km2 (954 square miles).

Edition 1 of the unnamed NTS map sheet number 96 A/14, produced at a scale of 1:50 000;

Edition 1 of the unnamed NTS map sheet number 96 H/2, produced at a scale of 1:50 000;

Edition 1 of the unnamed NTS map sheet number 96 H/3, produced at a scale of 1:50 000;

Edition 1 of the Cloud Bay NTS map sheet number 96 H/4, produced at a scale of 1:50 000;

Following a clockwise direction;

Commencing at the northeasterly corner of Sahtu lands parcel 76, being the intersection of the west bank of McVicar Arm of Great Bear Lake and the south bank of an unnamed stream, at approximate latitude 65°01′16″N and approximate longitude 120°58′54″W;

Thence in a clockwise direction, southwesterly along the boundary of Sahtu lands parcel 76, being the bank of McVicar Arm of Great Bear Lake, to a point at latitude 64°53′30″N;

Thence, west, in a straight line to a corner of Sahtu lands parcel 76 being the intersection of latitude 64°53′30″N and longitude 121°48′15″W;

Thence continuing in a clockwise direction along Sahtu lands parcel 76 boundary to a point at approximate latitude 64°55′00″N and approximate longitude 122°00′00″W;

Thence north along the longitude 122°00′00″W to a point on the boundary of Sahtu lands parcel 76, being the bank of Keith Arm of Great Bear Lake;

Thence generally northeasterly, continuing in a clockwise direction along the boundary of Sahtu lands parcel 76 to the point of commencement.

Said parcel containing approximately 430 km2 (166 square miles).
