Her Excellency the Governor General in Council, on the recommendation of the Minister of Indian Affairs and Northern Development, pursuant to paragraph 23(a) of the Territorial Lands ActFootnote a, hereby makes the annexed Order Respecting the Withdrawal from Disposal of Certain Tracts of Territorial Lands (Tuktut Nogait National Park, in the Northwest Territories and Nunavut).

Purpose
1 The purpose of this Order is to withdraw from disposal certain tracts of territorial lands to support the proposed future expansion to Tuktut Nogait National Park in the Northwest Territories and Nunavut.
Lands Withdrawn from Disposal
2 The tracts of territorial lands set out in Schedules 1 and 2 are withdrawn from disposal for the period beginning on the day on which this Order is made and ending on January 31, 2011.
Exceptions
Disposition of Substances or Materials
3 Section 2 does not apply to the disposition of substances or materials under the Territorial Quarrying Regulations.
Existing Rights and Interests
4 Section 2 does not apply to
(a) the locating of a mineral claim by the holder of a prospecting permit granted before the day on which this Order is made;
(b) the recording of a mineral claim that is referred to in paragraph (a) or that was located before the day on which this Order is made;
(c) the granting of a lease under the Northwest Territories and Nunavut Mining Regulations to a person with a recorded claim if the lease covers an area in the recorded claim;
(d) the issuance of a significant discovery licence under the Canada Petroleum Resources Act to a holder of an exploration licence that was issued before the day on which this Order is made if the significant discovery licence covers an area subject to the exploration licence;
(e) the issuance of a production licence under the Canada Petroleum Resources Act to a holder of a significant discovery licence that is referred to in paragraph (d) if the production licence covers an area subject to the significant discovery licence;
(f) the issuance of a production licence under the Canada Petroleum Resources Act to a holder of an exploration licence or a significant discovery licence that was issued before the day on which this Order is made if the production licence covers an area subject to the exploration licence or the significant discovery licence;
(g) the granting of a surface lease under the Territorial Lands Act to a holder of a recorded claim under the Northwest Territories and Nunavut Mining Regulations or of an interest under the Canada Petroleum Resources Act if the surface lease is required to allow the holder to exercise rights under the claim or interest; or
(h) the renewal of an interest.

SCHEDULE 1(Section 2)Tracts of Land Withdrawn from Disposal Tuktut Nogait National Park
Proposed addition to Tuktut Nogait National Park within Nunavut;
All that parcel being more particularly described as follows:
Commencing at a point being the intersection of the shoreline of Amundsen Gulf and the mouth of the Outwash River at approximate latitude 69°33′00″ North and approximate longitude 120°40′51″ West (the said point being a corner of the Inuvialuit Settlement Region);
thence southeasterly along the shoreline of Amundsen Gulf following the ordinary low water line to the point of intersection with longitude 119°00′00″ West at approximate longitude 69°16′05″ North;
thence south along said meridian of longitude to the point of intersection with latitude 68°10′00″ North;
thence west along said parallel of latitude to the point of intersection with longitude 119°45′00″ West;
thence south along said meridian of longitude to the point of intersection with the boundary between the Nunavut Settlement Region and the Sahtu Settlement Area, said point being at approximate latitude 67°44′30″ North;
thence northwesterly in a straight line to the southeast corner of the of the Inuvialuit Settlement Region at latitude 68°00′00″ North and approximate longitude 120°40′51″ West;
thence northerly along said approximate meridian of longitude (being easterly the limit of the Inuvialuit Settlement Region) to the point of commencement.
Saving and excepting therefrom following parcels:
Inuit Owned Lands parcel; CO-77 as shown on a plan recorded in the Canada Lands Surveys Records as 88507;
Inuit Owned Lands parcel CO-78 shown on a plan recorded in the Canada Lands Surveys Records as 92025;
Lots 1000 to 1003, Quad 87 C/5 as shown on a plan recorded in the Canada Lands Surveys Records as 91201;
Said parcel after exclusions containing approximately 9,700 km2 .
All coordinates are referred to the 1927 North American Datum and any references to straight lines mean points joined directly on the NAD 27 Universal Transverse Mercator (UTM) projection plane surface.
SCHEDULE 2(Section 2)Tracts of Land Withdrawn from Disposal Tuktut Nogait National Park
Proposed addition to Tuktut Nogait National Park within the Sahtu Settlement Area in the Northwest Territories;
All that parcel being more particularly described as follows (Geographic coordinates are North American Datum 1927):
Commencing at a point being the northeastern corner of the Sahtú Settlement Area as defined in Appendix A, Volume I of the Sahtú Dene and Métis Comprehensive Land Claim Agreement, said point having a latitude of 68°00′00″ north and an approximate longitude of 120°40′51″ west;
Thence southeasterly along the boundary of the said Sahtú Settlement Area to its intersection with latitude 67°45′00″ north at approximate longitude 119°42′39″ west;
Thence west along the parallel of said latitude to a point at latitude 67°45′00″ north and longitude 121°27′00″ west;
Thence northwesterly along a geodesic line to a point at latitude 68°00′00″ north and longitude 122°05′00″ west, said point being on the northerly boundary of the said Sahtú Settlement Area;
Thence easterly along the northerly boundary of the said Sahtú Settlement Area to the point of commencement;
Said parcel containing an area of approximately 1,841 km2.
