Exclusion Approval Order for Certain Former Members of the Canadian Forces (SI/2025-20)

Her Excellency the Governor General in Council, on the recommendation of the President of the King’s Privy Council for Canada, under section 20 of the Public Service Employment ActFootnote ^a, approves the exclusion, by the Public Service Commission, from the application of section 35.11Footnote ^b of that Act of persons who

• Return to footnote ^aS.C. 2003, c. 22, ss. 12, 13

• Return to footnote ^bS.C. 2015, c. 5, s. 4

• (a) during the period beginning on November 13, 2020 and ending on January 18, 2024,

  • (i) completed their third year of service in the Canadian Forces, and

  • (ii) were honourably released within the meaning of regulations made under the National Defence ActFootnote ^c; and

    • Return to footnote ^cR.S., c. N-5

• (b) created an account in the Public Service Resourcing System on or before January 18, 2024.

Whereas the Public Service Commission has decided that it is neither practicable nor in the best interests of the public service to apply section 35.11Footnote ^b of the Public Service Employment ActFootnote ^a to persons who

• (a) during the period beginning on November 13, 2020 and ending on January 18, 2024,

  • (i) completed their third year of service in the Canadian Forces, and

  • (ii) were honourably released within the meaning of regulations made under the National Defence ActFootnote ^c; and

• (b) created an account in the Public Service Resourcing System on or before January 18, 2024;

And whereas, in accordance with subsection 20(2) of the Public Service Employment ActFootnote ^a, the Public Service Commission has consulted with the employer;

Therefore, the Public Service Commission, under section 20 of the Public Service Employment ActFootnote ^a, excludes from the application of section 35.11Footnote ^b of that Act persons who

• (a) during the period beginning on November 13, 2020 and ending on January 18, 2024,

  • (i) completed their third year of service in the Canadian Forces, and

  • (ii) were honourably released within the meaning of regulations made under the National Defence ActFootnote ^c; and

• (b) created an account in the Public Service Resourcing System on or before January 18, 2024.
