Order Respecting the Remission of a Portion of Certain Fees Paid in Respect of Certain Licensed Activities Under the Atomic Energy Control Act

His Excellency the Governor General in Council, considering that it is in the public interest to do so, is pleased hereby, on the recommendation of the Minister of Energy, Mines and Resources and the Treasury Board, pursuant to subsection 23(2.1)Footnote * of the Financial Administration Act, to make the annexed Order respecting the remission of a portion of certain fees paid in respect of certain licensed activities under the Atomic Energy Control Act.

Short Title

 This Order may be cited as the Atomic Energy Control Board Cost Recovery Fees Remission Order.

Interpretation

 Words and expressions in this Order have the same meaning as in the AECB Cost Recovery Fees Regulations, 1993.

Application

 This Order applies in respect of annual and bi-annual fees paid pursuant to the AECB Cost Recovery Fees Regulations and the AECB Cost Recovery Fees Regulations, 1993.

Remission

 Remission is hereby granted of a portion of the fees that were paid but not refunded under the AECB Cost Recovery Fees Regulations and the AECB Cost Recovery Fees Regulations, 1993, so that

  • (a) any person who pays a fee for a licence or approval, and requests the revocation of the licence or approval or requests a change in the licensed or approved activity, shall, if the Board or a designated officer approves the request pursuant to the Atomic Energy Control Regulations or the Uranium and Thorium Mining Regulations, be refunded by the Board the portion of the fee paid that is equal to the product obtained by multiplying

    • (i) the quotient obtained by dividing the amount of the applicable fee for the licence or approval by the number of days in the fee period

    by

    • (ii) the number of days remaining in the fee period, beginning with the day on which the Board or a designated officer approves the revocation or change in the licensed or approved activity;

  • (b) any person who pays an annual or a bi-annual fee for a licence or approval and the fee for the licence or approval is subsequently changed to an hourly rate fee shall be refunded by the Board the portion of the fee paid that is equal to the product obtained by multiplying

    • (i) the quotient obtained by dividing the amount of the fee paid by the number of days in the fee period

    by

    • (ii) the number of days remaining in the fee period as of the day of the change to an hourly rate fee; and

  • (c) any person who pays a fee for a licence and the fee for the licence is subsequently reduced shall be refunded by the Board the portion of the fee paid that is equal to the product obtained by multiplying

    • (i) the quotient obtained by dividing the difference obtained by subtracting the current fee from the fee paid, by the number of days in the fee period

    by

    • (ii) the number of days remaining in the fee period as of the day of the reduction of the fee.
