Order Authorizing the Minister of the Environment to Prescribe Charges (SI/98-89)

His Excellency the Governor General in Council, on the recommendation of the Treasury Board,

• (a) pursuant to paragraph 19(1)(b)Footnote ^a of the Financial Administration Act, hereby authorizes the Minister of the Environment to prescribe by order the charges to be paid to the Canadian Environmental Assessment Agency (the Agency) by the proponent of a project for the services that are provided by the Agency on behalf of Her Majesty in right of Canada in the course of an environmental assessment conducted by a review panel under the Canadian Environmental Assessment Act; and

• (b) pursuant to subsection 23(2.1)Footnote ^b of the Financial Administration Act, if a service is not rendered to the proponent and the charges have already been paid in whole or in part, considering that it is in the public interest to remit the charges, hereby grants remission of the charges paid so that the Agency reimburses the charges to the person who paid them.
