Whereas, pursuant to subsection 5.5(1)Footnote a of the Aeronautics Act, a copy of the proposed Moose Jaw Airport Zoning Regulations, substantially in the form annexed hereto, was published in two successive issues of the Canada Gazette, Part I, on March 31 and April 7, 2001 and in two successive issues of the Moose Jaw Times Herald on March 23 and 24, 2001 and the Regina Leader Post on April 6 and 7, 2001 and a reasonable opportunity was thereby afforded to interested persons to make representations to the Minister of National Defence with respect thereto;

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of National Defence, pursuant to subsection 5.4(2) of the Aeronautics Act, hereby makes the annexed Moose Jaw Airport Zoning Regulations.
Interpretation
1 The definitions in this section apply in these Regulations.
- airport
airport means the Moose Jaw Airport, situated in the Municipality of Moose Jaw, in the Province of Saskatchewan. (aéroport)
- airport zoning reference point
airport zoning reference point means a point at the airport 573.02 m above sea level, more particularly described in Part 1 of the schedule. (point de repère du zonage de l’aéroport)
- approach surfaces
approach surfaces means the imaginary inclined planes that extend upward and outward from each end of a strip, more particularly described in Part 3 of the schedule. (surface d’approche)
- outer surface
outer surface means an imaginary plane located above and in the immediate vicinity of the airport, more particularly described in Part 5 of the schedule, the outer limits of which are described in Part 6 of the schedule. (surface extérieure)
- strip
strip means a rectangular portion of the landing area of the airport, including the runway, that is prepared for the take-off and landing of aircraft in a particular direction, more particularly described in Part 2 of the schedule. (bande)
- transitional surface
transitional surface means an imaginary inclined plane that extends upward and outward from the lateral limits of a strip and its approach surfaces, more particularly described in Part 4 of the schedule. (surface de transition)
Application
2 These Regulations apply in respect of all lands, other than lands that form part of the airport but including public road allowances, that are adjacent to, or in the vicinity of, the airport, the outer limits of which lands are described in Part 7 of the schedule.
Building Restrictions
3 No person shall place, erect or construct or permit to be placed, erected or constructed on any land in respect of which these Regulations apply any building, structure or object, or an addition to any existing building, structure or object, the highest point of which would exceed in elevation at the location of the building, structure or object
(a) an approach surface;
(b) the outer surface; or
(c) a transitional surface.
Natural Growth
4 No owner or lessee of any lands in respect of which these Regulations apply shall permit an object of natural growth to exceed in elevation any of the surfaces referred to in section 3 that project immediately over and above the surface of the land at the location of the object.
Electronic Zoning
5 No owner or lessee of any lands in respect of which these Regulations apply shall permit those lands or any part of them to be used in a manner that may cause interference with aeronautical communications.
Bird Hazards
6 (1) Subject to subsection (2), in order to reduce bird hazards to aviation, no owner or lessee of lands in respect of which these Regulations apply shall permit those lands or any part of them to be used as a site for
(a) a sanitary land fill;
(b) a food garbage disposal site;
(c) a sewage lagoon; or
(d) an open water storage reservoir.
(2) An owner or lessee of lands to which these Regulations apply, other than those lands described in Part 8 of the schedule, may permit those lands or any part of them to be used as a site for an open water storage reservoir in either of the following cases:
(a) the total surface area of the reservoir does not exceed one hectare; or
(b) in the case of lands that are dry ponds,
(i) measures are taken to reduce bird hazards to aviation, and
(ii) the approval of the Minister is obtained if the lands are used for open water storage for a period in excess of 48 hours more than once per calendar year.
SCHEDULE(Sections 1, 2 and 6)
PART 1Description of the Airport Zoning Reference Point
The airport zoning reference point is a point on the centre line of runway 10L-28R at the beginning of that runway for approach 28R.
PART 2Description of Each Strip
Each strip, shown on Department of Public Works and Government Services Canada Moose Jaw Airport Zoning Plan No. E.3054, dated August 1997, is described as follows:
(a) the strip associated with runway 10L-28R is 300 m in width, 150 m being on each side of the centre line of the runway, and 2,656.25 m in length;
(b) the strip associated with runway 10R-28L is 300 m in width, 150 m being on each side of the centre line of the runway, and 2,339.10 m in length; and
(c) the strip associated with runway 03-21 is 300 m in width, 150 m being on each side of the centre line of the runway, and 1,156.32 m in length.
PART 3Description of Approach Surfaces
The approach surfaces, shown on Department of Public Works and Government Services Moose Jaw Airport Zoning Plan No. E.3054, dated August 1997, are surfaces abutting each end of the strips associated with runways 10L-28R, 10R-28L and 03-21, and that are more particularly described as follows:
(a) a surface abutting the end of the strip associated with runway approach 10L consisting of an inclined plane having a ratio of 1 m measured vertically to 60 m measured horizontally rising to an intersection with the outer surface, thence the approach surface shall slope upward at a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15,000 m measured horizontally from the end of the strip, the outer ends of the imaginary horizontal line being 2,400 m from the projected centre line; the imaginary horizontal line being 291.1 m measured vertically above the assigned elevation at the end of the strip;
(b) a surface abutting the end of the strip associated with runway approach 28R consisting of an inclined plane having a ratio of 1 m measured vertically to 60 m measured horizontally rising to an intersection with the outer surface, thence the approach surface shall slope upward at a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15,000 m measured horizontally from the end of the strip, the outer ends of the imaginary horizontal line being 2,400 m from the projected centre line; the imaginary horizontal line being 291.0 m measured vertically above the assigned elevation at the end of the strip;
(c) a surface abutting the end of the strip associated with runway approach 10R consisting of an inclined plane having a ratio of 1 m measured vertically to 60 m measured horizontally rising to an intersection with the outer surface, thence the approach surface shall slope upward at a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15,000 m measured horizontally from the end of the strip, the outer ends of the imaginary horizontal line being 2,400 m from the projected centre line; the imaginary horizontal line being 291.6 m measured vertically above the assigned elevation at the end of the strip;
(d) a surface abutting the end of the strip associated with runway approach 28L consisting of an inclined plane having a ratio of 1 m measured vertically to 60 m measured horizontally rising to an intersection with the outer surface, thence the approach surface shall slope upward at a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15,000 m measured horizontally from the end of the strip, the outer ends of the imaginary horizontal line being 2,400 m from the projected centre line; the imaginary horizontal line being 291.7 m measured vertically above the assigned elevation at the end of the strip;
(e) a surface abutting the end of the strip associated with runway approach 03 consisting of an inclined plane having a ratio of 1 m measured vertically to 60 m measured horizontally rising to an intersection with the outer surface, thence the approach surface shall slope upward at a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15,000 m measured horizontally from the end of the strip, the outer ends of the imaginary horizontal line being 2,400 m from the projected centre line; the imaginary horizontal line being 290.45 m measured vertically above the assigned elevation at the end of the strip; and
(f) a surface abutting the end of the strip associated with runway approach 21 consisting of an inclined plane having a ratio of 1 m measured vertically to 60 m measured horizontally rising to an intersection with the outer surface, thence the approach surface shall slope upward at a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15,000 m measured horizontally from the end of the strip, the outer ends of the imaginary horizontal line being 2,400 m from the projected centre line; the imaginary horizontal line being 291.61 m measured vertically above the assigned elevation at the end of the strip.
PART 4Description of Each Transitional Surface
Each transitional surface, shown on Department of Public Works and Government Services Canada Moose Jaw Airport Zoning Plan No. E.3054, dated August 1997, being a surface consisting of an inclined plane rising at a ratio of 1 m measured vertically to 7 m measured horizontally at right angles to the centre line and centre line produced of each strip and extending upward and outward from the lateral limits of each strip and its approach surfaces to an intersection with the outer surface or another transitional surface of an adjoining strip.
PART 5Description of the Outer Surface
The outer surface, shown on Department of Public Works and Government Services Canada Moose Jaw Airport Zoning Plan No. E.3054, dated August 1997, is an imaginary surface that consists of a common plane established at a constant elevation of 45 m above the assigned elevation of the airport zoning reference point, except that, where the common plane is less than 9 m above the ground at any point, the outer surface is an imaginary plane located at 9 m above the ground.
PART 6Description of the Outer Limits of the Outer Surface
Commencing at the Northeast corner of Section Twenty-eight (28), Township Fifteen (15), Range Twenty-six (26), West of the Second (2nd) Meridian; thence southerly along the easterly limit of said Section Twenty-eight (28) to the Northeast corner of the Southeast Quarter of said Section; thence westerly along the northerly limit of said Quarter Section to the Northwest corner thereof; thence southerly along the westerly limit of said Quarter Section to its intersection with the northerly limit of Registered Plan 74MJ10679; thence westerly along the northerly limit of said Plan, Registered Plan 73MJ08964, across the intervening Road Allowances, and westerly along the northerly limit of Registered Plan 65MJ02855 to its intersection with the westerly limit of the Southeast Quarter of Section Thirty (30), said Township and Range; thence northerly along the westerly limit of said Quarter Section to the Northwest corner thereof; thence westerly along the southerly limits of the Northwest Quarter of said Section Thirty (30), the Northeast Quarter of Section Twenty-five (25), Township Fifteen (15), Range Twenty-seven (27), West of the Second (2nd) Meridian, and across the intervening Road Allowance, to the Southwest corner of said Northeast Quarter of Section Twenty-five (25); thence northerly along the westerly limit of said Quarter Section to the Northwest corner thereof; thence westerly along the southerly limit of the Southwest Quarter of Section Thirty-six (36) to the Southwest corner thereof; thence northerly along the westerly limit of the said Quarter Section to the Northwest corner thereof; thence westerly across the Road Allowance and along the southerly limit of the north Half of Section Thirty-five (35) to its intersection with the easterly limit of Registered Plan 78MJ03673; thence northerly along the easterly limit of said Plan and its production across the Road Allowance, to the south limit of the Southwest Quarter of Section Two (2), Township Sixteen (16), Range Twenty-seven (27), West of the Second (2nd) Meridian; thence westerly along the southerly limit of the said Southwest Quarter, the east Half of Section Three (3), and across the intervening Road Allowance, to the Southwest corner of the said east Half; thence northerly along the westerly limit of the said east Half of Section Three (3) and the east Half of Section Ten (10) to the Northwest corner thereof; thence westerly along the northerly limit of the Northwest Quarter of the said Section Ten (10) a distance of twenty-eight and forty-nine one hundredths (28.49) metres to a point thereon; thence north-easterly to a point on the most southerly limit of Registered Plan 84MJ12130 in the Northeast Quarter of Section Twenty-three (23), said Township and Range, being distant Seven Hundred and Eleven and Twenty-four Hundredths (711.24) metres westerly thereon from the easterly limit thereof; thence easterly along the southerly limit of the said Plan and its production easterly across the Road Allowance and easterly along the southerly limit of Registered Plan H.1699 to the easterly limit of said Plan H.1699; thence southerly along the easterly limits of said Quarter, Sections Fifteen (15), Ten (10) and Three (3), and across the intervening Road Allowances, to the most northerly intersection thereof with Registered Plan C.H.2827; thence southerly along the westerly limit of said Plan to its intersection with the easterly limit of the Southeast Quarter of Section Three (3); thence southerly along the easterly limit of said Southeast Quarter of Section Three (3) a distance of Twenty-three and Thirty-seven one hundredths (23.37) metres; thence south-westerly to a point on the northerly limit of Section Twenty-seven (27), Township Fifteen (15), Range Twenty-six (26), West of the Second (2nd) Meridian, distant easterly thereon Three Hundred and Sixty-four and Fifty-seven one hundredths (364.57) metres from the Northeast corner of the Northeast Quarter of Section Twenty-eight (28), said Township and Range; thence westerly along the northerly limit of the said Section Twenty-seven (27) and its production across the Road Allowance, to the point of commencement.
PART 7Description of the Outer Limits of the Land Affected by These Regulations
Commencing at the Northwest corner of the Southwest Quarter of Section Thirty (30), Township Sixteen (16), Range Twenty-six (26), West of the Second (2nd) Meridian; thence easterly along the northerly limits of the south Halves of Sections Thirty (30), Twenty-nine (29), and the Southwest Quarter of Section Twenty-eight (28), and across the intervening Road Allowances, to the Northeast corner of the said Southwest Quarter; thence southerly along the easterly limit of the said southwest Quarter of Section Twenty-eight (28) to the northerly limit of Parcel A, Plan L1957, as amended by Master of Titles Order 65MJ07584; thence easterly along the northerly limit of Parcel A to the Northeast corner thereof, then northerly to the Southeast corner of Block 33 of Plan L1957, and continuing northerly along the easterly limit thereof to an intersection thereon with the straight production westerly of the northerly limit of that portion of Plan N1015 which was cancelled by the Master of Titles Order 62MJ01650; PART 8Description of Lands Excepted from the Application of Subsection 6(2)
Those areas lying within the outer limits of lands affected by these Regulations, as those limits are more particularly described in Part 7, and which are shown on Department of Public Works and Government Services Canada Moose Jaw Airport Zoning Plan No. E.3054, dated August 1997 as:
(a) 1:50 approach surfaces;
(b) 1:60 approach surfaces; and
