Passenger Information Regulations (Preclearance Act)

Her Excellency the Governor General in Council, on the recommendation of the Minister of Foreign Affairs, pursuant to paragraph 38(1)(c) of the Preclearance ActFootnote a, hereby makes the annexed Passenger Information Regulations (Preclearance Act).

Definitions

 The following definitions apply in these Regulations.

Act

Act means the Preclearance Act. (Loi)

Agreement

Agreement means the Agreement on Air Transport Preclearance between The Government of Canada and The Government of the United States of America, signed January 18, 2001. (Accord)

flight

flight means the segment of air travel by which a passenger of a transportation company arrives in Canada. (vol)

passenger

passenger means a person described in section 29 of the Act. (passager)

Specified Passenger Information

 For the purposes of sections 30 to 32 of the Act,specified passenger information means the information, in respect of a passenger, set out in column 1 of Schedules 1 and 2 that is accessible by a transportation company referred to in subsection 30(1) of the Act from the Advance Passenger Information System (“APIS”) or from the passenger’s passenger name record (“PNR”).

Coming into Force

Footnote * These Regulations come into force on the day on which section 38 of the Preclearance Act, being chapter 20 of the Statutes of Canada, 1999, comes into force.
