8 For the purposes of section 11 of the Act, the Minister may
(a) waive the requirement in subparagraph 6(2)(a)(i) or 7(2)(a)(i) or (b)(i) of the Act that the individual be at least 18 years of age on December 31 of the year preceding the particular year if the beneficiary is not a qualified dependant of an eligible individual; and
(b) waive the period requirement in paragraph 2(b) or 3(c) if
(i) the issuer has exercised the standard of care in the operation of its electronic systems, including those related to back-up and systems security and networking, that is reasonable in the circumstances, and
(ii) despite subparagraph (i), there is a technical malfunction of the electronic systems of either the issuer or the Minister, or other event that is beyond the reasonable control of the issuer or the Minister, that directly impairs the continued normal functioning of the electronic systems and prevents the transactions and exchanges of information relating to the application for the grant or bond from being submitted within the required period.
