Proclamation Declaring that the Government Corporations Operation Act Ceases to Apply to Trans Mountain Corporation

TO ALL TO WHOM these presents shall come or whom the same may in any way concern,

GREETING:

A Proclamation

Whereas section 6 of the Government Corporations Operation Act (the “Act”) provides that that Act applies to a corporation only from the date of the issue of a proclamation by the Governor in Council declaring that Act to be applicable to the corporation;

Whereas by proclamation issued on July 18, 2018 and registered on July 27, 2018 as SOR/2018-168, the Act was declared to be applicable to Project Deliver II Ltd. under section 6 of that Act;

Whereas on August 17, 2018, the corporate name of Project Deliver II Ltd. was changed to Trans Mountain Corporation;

Whereas subsection 7(1) of the Act provides that the Governor in Council may issue a proclamation declaring that that Act ceases to apply to a corporation in respect of which a proclamation has been issued under section 6 of that Act;

And whereas by Order in Council P.C. 2022-361 of April 20, 2022, the Governor in Council directed that a proclamation do issue declaring that the Government Corporations Operation Act ceases to apply to Trans Mountain Corporation, effective on the day on which the proclamation is issued;

Now Know You that We, by and with the advice of Our Privy Council for Canada, under subsection 7(1) of the Government Corporations Operation Act, do by this proclamation declare that the Government Corporations Operation Act ceases to apply to Trans Mountain Corporation, effective on the day on which the proclamation is issued.

Of all which Our loving subjects and all others whom these presents may concern are required to take notice and to govern themselves accordingly.

In testimony whereof, We have caused this Our Proclamation to be published and the Great Seal of Canada to be affixed to it.

Our Right Trusty and Well-beloved Mary May Simon, Chancellor and Principal Companion of Our Order of Canada, Chancellor and Commander of Our Order of Military Merit, Chancellor and Commander of Our Order of Merit of the Police Forces, Governor General and Commander-in-Chief of Canada.
