Landfill Methane Regulations (SOR/2025-279)

Marginal note:Application

• 3 (1) Subject to subsections (2) and (3), these Regulations apply to

  • (a) any landfill in which any quantity of municipal solid waste was disposed of after January 1, 2010 and that has more than 450 000 tonnes of municipal solid waste in place; and

  • (b) any landfill in which more than 20 000 tonnes of municipal solid waste was disposed of in 2025 or is disposed of in any subsequent calendar year and that has more than 200 000 tonnes of municipal solid waste in place.

  (2) These Regulations do not apply to a landfill into which only the following types of waste have been disposed of:

  • (a) hazardous waste;

  • (b) non-biodegradable waste, such as soil, rock, asphalt, concrete, brick, glass, ceramics, clay products, inert slag, asbestos-containing waste and metals;

  • (c) waste produced by forest products operations; or

  • (d) construction and demolition waste.

• Marginal note:Non-application — non-contiguous portions

  (3) These Regulations do not apply to any portion of a landfill

  • (a) that is not contiguous with any other portion of the landfill;

  • (b) in which no municipal solid waste was disposed of after January 1, 2010; and

  • (c) that is under final cover.
