Tariff of Fees for Services Performed By Port Wardens

His Excellency the Governor General in Council, on the recommendation of the Minister of Transport and the Treasury Board, pursuant to sections 627 and 633 of the Canada Shipping Act, is pleased hereby to revoke the Port Wardens Regulations made by Order in Council P.C. 1968-1915 of 8th October, 1968Footnote 1, and to make the annexed Tariff of Fees for Services Performed by Port Wardens in substitution therefor.

Short Title

 This Tariff may be cited as the Port Wardens Tariff.

Interpretation

 In this Tariff, Act means the Canada Shipping Act.

Application

 This Tariff applies to every harbour in Canada for which a port warden has been appointed under the Act.

Fees

 The master or owner of a ship in respect of which a port warden has performed a service described in Column I of an item of the schedule shall pay to the port warden the fee set out in Column II of that item.

Duplication of Services

 Where a certificate of readiness to load is issued pursuant to subsection 614(2) of the Act at a port of call for a chamber or compartment in a ship, and the fee therefor as set out in the schedule is paid but cargo is not loaded at that port, the fee shall not be payable in respect of that chamber or compartment at the port where the cargo is loaded.

Tonnage

 For the purpose of the fees set out in the schedule, tonnage of lumber, logs, pitprops and pulpwood shall be computed on the basis that

  • (a) 1,000 feet, boardmeasure, equal one and one-half tonnes; and

  • (b) one fathom equals four tonnes.
