Order Granting Authority to Regulate the Marketing in Interprovincial and Export Trade of Wood Produced in the Province of Quebec

His Excellency the Governor General in Council, on the recommendation of the Minister of Agriculture, pursuant to section 2 of the Agricultural Products Marketing Act, is pleased hereby to revoke the Quebec Wood Order made by Order in Council P.C. 1981-1158 of 7th May, 1981Footnote *, the Eastern Townships Wood Order, C.R.C., c. 261, the Gaspesia Pulpwood Order, C.R.C., c. 250, the Gatineau Wood Order, C.R.C., c. 262, the Pontiac Wood Order, C.R.C., c. 263 and the Quebec-South Wood Order, C.R.C., c. 264 and to make the annexed Order granting authority to regulate the marketing in interprovincial and export trade of wood produced in the Province of Quebec, in substitution therefor.

Short Title
1 This Order may be cited as the Quebec Wood Order, 1983.
Interpretation
2 In this Order,
- Act
Act means an Act of the Province of Quebec entitled An Act Respecting the Marketing of Agricultural, Food and Fish Products (R.S.Q., c. M-35.1); (Loi)
- Commodity Board
Commodity Board means, in respect of a Plan set out in Column II of an item of the schedule, the Wood Producers’ Board set out in Column I of that item that is responsible for the implementation and administration of that Plan; (office)
- Plan
Plan means a plan established under the Act; (plan)
- wood
wood means wood produced in the Province of Quebec. (bois)

Interprovincial and Export Trade
3 A Commodity Board is authorized to regulate the marketing of wood in interprovincial and export trade, and for such purposes may, with respect to persons and property situated within the Province of Quebec, exercise all or any powers like the powers exercisable by it in relation to the marketing of wood locally within that province under the Act and under the Plan administered by that Commodity Board.

Levies
4 A Commodity Board is authorized, in relation to the powers granted to it under section 3 with respect to the marketing of wood in interprovincial and export trade, to make orders fixing, imposing and collecting levies or charges from persons situated within the Province of Quebec who are engaged in the production or marketing of wood and for such purposes classifying such persons into groups and fixing the levies or charges payable by the members of the different groups in different amounts, and the Commodity Board may use such levies or charges for its purposes, including the creation of reserves, the payment of expenses and losses resulting from the sale or disposal of wood and the equalization or adjustment among producers of wood of moneys realized from the sale thereof during such period or periods of time as it may determine.
