Regulations Respecting Zoning at Saskatoon Airport

Whereas, pursuant to section 4.5 of the Aeronautics Act, a copy of the proposed Zoning regulations respecting Saskatoon Airport, substantially in the form set out in the schedule hereto, was published in two successive issues of the Canada Gazette Part I on May 16th and 23rd, 1987 and in two successive issues of the Star-Phoenix on July 2nd and 6th, 1987, and a reasonable opportunity was thereby afforded to interested persons to make representations to the Minister of Transport with respect thereto.

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to section 4.4 of the Aeronautics Act, is pleased hereby to revoke the Saskatoon Airport Zoning Regulations, C.R.C., c. 108, and to make the annexed Regulations respecting zoning at Saskatoon Airport in substitution therefor.

Short Title

 These Regulations may be cited as the Saskatoon Airport Zoning Regulations.

Interpretation

  •  (1) In these Regulations,

    airport

    airport means the Saskatoon Airport, in the vicinity of Saskatoon, in the Province of Saskatchewan; (aéroport)

    airport reference point

    airport reference point means the point described in Part I of the schedule; (point de repère de l’aéroport)

    approach surface

    approach surface means an imaginary inclined plane that extends upward and outward from each end of a strip, which approach surface is more particularly described in Part II of the schedule; (surface d’approche)

    Minister

    Minister means the Minister of Transport; (ministre)

    outer surface

    outer surface means an imaginary surface located above and in the immediate vicinity of the airport, which outer surface is more particularly described in Part III of the schedule; (surface extérieure)

    strip

    strip means the rectangular portion of the landing area of the airport including the runway prepared for the take-off and landing of aircraft in a particular direction, which strip is more particularly described in Part IV of the schedule; (bande)

    transitional surface

    transitional surface means an imaginary inclined plane that extends upward and outward from the lateral limits of a strip and its approach surfaces, which transitional surface is more particularly described in Part V of the schedule. (surface de transition)

  • (2) For the purposes of these Regulations, the elevation of the airport reference point is 495.30 m above sea level.

Application

 These Regulations apply to all the lands, including public road allowances, adjacent to or in the vicinity of the airport, which lands are more particularly described as follows:

  • (a) the lands within the outer limits of lands described in Part VI of the schedule; and

  • (b) the lands directly under that portion of the approach surfaces that extend beyond the said outer limits.

General

 No person shall erect or construct on any land to which these Regulations apply, any building, structure or object or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at the location of that point

  • (a) the approach surfaces;

  • (b) the outer surface; or

  • (c) the transitional surfaces.

Natural Growth

 Where an object of natural growth on any land to which these Regulations apply exceeds in elevation any of the surfaces referred to in section 4, the Minister may require that the owner or lessee of the land on which that object is growing remove the excessive growth.

Disposal of Waste

 No owner or lessee of any land to which these Regulations apply shall permit such land or any part of it to be used for the disposal of any waste that is edible by or attractive to birds.

SCHEDULE(Sections 2 and 3)

PART IDescription of the Airport Reference Point

The airport reference point, shown on Saskatoon Airport Zoning Plan No. E.1754 dated June 12, 1984, is described as follows:

Premising that the bearings hereinafter mentioned are astronomical and are referred to the centre line of strip 08R-26L of the Saskatoon Airport, Saskatoon, Saskatchewan as South 79°01′20″ East; Commencing at the northeast corner of the southeast quarter of Section 13, Township 37, Range 6, West of the 3rd Meridian; thence southerly along the easterly boundary of the said southeast quarter of Section 13 a distance of 198.27 m more or less to an intersection with the centre line of strip 08R-26L; thence South 79°01′20″ East along the said centre line a distance of 940.25 m more or less to an intersection with the centre line of strip 14-32; thence South 49°01′20″ East a distance of 822.96 m to a point designated as the Airport Reference Point.

PART IIDescription of the Approach Surfaces

The approach surfaces, shown on Saskatoon Airport Zoning Plan No. E.1754 dated June 12, 1984, are surfaces abutting each end of the strips associated with the runways designated 14-32, 08R-26L and 08L-26R and are described as follows:

  • (a) a surface abutting the end of the strip associated with runway approach 14 consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15 240 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 2 316.48 m from the projected centre line; said imaginary horizontal line being 304.8 m measured vertically above the elevation at the end of the strip;

  • (b) a surface abutting the end of the strip associated with runway approach 32 consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15 240 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 2 316.48 m from the projected centre line; said imaginary horizontal line being 304.8 m measured vertically, above the elevation at the end of the strip;

  • (c) a surface abutting the end of the strip associated with runway approach 08R consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15 240 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 2 316.48 m from the projected centre line; said imaginary horizontal line being 304.8 m measured vertically above the elevation at the end of the strip;

  • (d) a surface abutting the end of the strip associated with runway approach 26L consisting of an inclined plane having a ratio of 1 m measured vertically to 50 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15 240 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 2 316.48 m from the projected centre line; said imaginary horizontal line being 304.8 m measured vertically, above the elevation at the end of the strip;

  • (e) a surface abutting the end of the strip associated with runway approach 08L consisting of an inclined plane having a ratio of 1 m measured vertically to 25 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 2 529.84 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 283.46 m from the projected centre line; said imaginary horizontal line being 101.19 m measured vertically above the elevation at the end of the strip; and

  • (f) a surface abutting the end of the strip associated with runway approach 26R consisting of an inclined plane having a ratio of 1 m measured vertically to 25 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 2 529.84 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 283.46 m from the projected centre line; said imaginary horizontal line being 101.19 m measured vertically, above the elevation at the end of the strip.

PART IIIDescription of the Outer Surface

The outer surface, shown on Saskatoon Airport Zoning Plan No. E.1754 dated June 12, 1984, is an imaginary surface located at a common plane established at a constant elevation of 45 m above the elevation of the airport reference point, except that, where that common plane is less than 9 m above the surface of the ground, the outer surface is an imaginary surface located at 9 m above the surface of the ground.

PART IVDescription of Each Strip

The strips shown on Saskatoon Airport Zoning Plan No. E.1754 dated June 12, 1984 are described as follows:

  • (a) the strip associated with runway 08R-26L being 365.76 m in width, 182.88 m on each side of the centre line of the runway and 3 383.28 m in length;

  • (b) the strip associated with runway 14-32 being 365.76 m in width, 182.88 m on each side of the centre line of the runway and 3 139.44 m in length; and

  • (c) the strip associated with runway 08L-26R being 60.96 m in width, 30.48 m on each side of the centre line of the runway and 1 036.32 m in length.

PART VDescription of Each Transitional Surface

The transitional surfaces, shown on Saskatoon Airport Zoning Plan No. E.1754 dated June 12, 1984, are described as follows:

  • (a) the transitional surfaces associated with runways 08R-26L and 14-32 are surfaces consisting of an inclined plane rising at a ratio of 1 m measured vertically to 7 m measured horizontally at right angles to the centre line and projected centre line of the strips extending upward and outward from the lateral limits of the strips and their approach surfaces to an intersection with the outer surface or another transitional surface of an adjoining strip; and

  • (b) the transitional surface associated with runway 08L-26R is a surface consisting of an inclined plane rising at a ratio of 1 m measured vertically to 5 m measured horizontally at right angles to the centre line and projected centre line of the strip extending upward and outward from the lateral limits of the strip and its approach surfaces to an intersection with the outer surface or another transitional surface of an adjoining strip.

PART VIDescription of the Lands to Which These Regulations Apply

The boundary of the outer limits of lands, shown on Saskatoon Airport Zoning Plan No. E.1754 dated June 12, 1984, is described as follows:

COMMENCING at the southwest corner of Section 1, Township 37, Range 6, West of the 3rd Meridian;

THENCE southerly across 33rd Street and along the easterly limit of Byng Avenue to the northerly limit of John A. MacDonald Road;

THENCE easterly along the northerly limit of John A. MacDonald Road to an intersection with the production northerly of the east limit of the lane bordering on the westerly limit of Block 679, Registered Plan 72-S-22316;

THENCE southerly across the said John A. MacDonald Road and continuing southerly and easterly along the easterly and northerly limit of said lane following the limits of Block 679, Registered Plan 72-S-22316 and continuing easterly along the northerly limit of the said lane and its production easterly to an intersection with the easterly limit of Confederation Drive;

THENCE southerly along the easterly limit of Confederation Drive to the northerly limit of Massey Drive;

THENCE easterly along the northerly limit of Massey Drive and its production southeasterly to the southeasterly limit of Northumberland Avenue;

THENCE southwesterly along the southeasterly limit of Northumberland Avenue to the northwest corner of Lot 72, Block 473, Registered Plan 67-S-29100;

THENCE easterly following the southerly limit of the lane through Block 473 to an intersection with the westerly limit of Circle Drive;

THENCE southerly along the westerly limit of Circle Drive to an intersection with the north limit of the south half of Section 31, Township 36, Range 5, West of the 3rd Meridian;

THENCE easterly along the northerly limit of said south half of Section 31 and continuing easterly along a line to a point being the intersection of the northerly limit of 28th Street and the production northerly of the easterly limit of Avenue N;

THENCE southerly along the said easterly limit of Avenue N and the production thereof to the southerly boundary of Bedford Road;

THENCE easterly along the southerly limit of Bedford Road to the westerly limit of Avenue E;

THENCE southerly along the westerly limit of Avenue E to an intersection with the production westerly of the northerly limit of 25th Street;

THENCE easterly along the said northerly limit of 25th Street to the westerly limit of Avenue A;

THENCE northerly along the said westerly limit of Avenue A to an intersection with the westerly production of the southerly limit of Parcel D, Registered Plan B.V. 6120;

THENCE easterly along the southerly limits of said Parcel D and Parcel Y, Registered Plan G.746 to the westerly limit of 29th Street;

THENCE northerly, easterly and southerly along the westerly, northerly and easterly limits respectively of said 29th Street to the southerly limit of Parcel 1, Registered Plan 76-S-00924;

THENCE easterly along the said southerly limit of Parcel 1, to the southeasterly corner of Parcel G, Registered Plan C.R. 3112;

THENCE northerly along the easterly limit of Parcel G to the northerly limit of Section 33, Township 36, Range 5, West of the 3rd Meridian;

THENCE easterly along the said northerly limit of Section 33 to the westerly limit of Warman Road;

THENCE northerly along the said westerly limit of Warman Road to an intersection with the westerly production of the southerly limit of Legal Subdivision 4, Section 10, Township 37, Range 5, West of the 3rd Meridian;

THENCE easterly along the said southerly limit of Legal Subdivision 4 to the southeast corner thereof;

THENCE northerly along the said easterly limit of said Legal Subdivision 4 to the northwest corner thereof;

THENCE easterly along the northerly limits of Legal Subdivisions 2 and 3 to the southwest corner of Legal Subdivision 8 of said Section 10;
