Order Granting Authority to the Office Des Producteurs De Fruits Et Légumes Du Québec to Regulate the Marketing of Vegetables for Processing Produced in the Province of Quebec in Interprovincial and Export Trade

His Excellency the Governor General in Council, on the recommendation of the Minister of Agriculture, pursuant to section 2 of the Agricultural Products Marketing Act, is pleased hereby to make the annexed Order granting authority to the Office des producteurs de fruits et légumes du Québec to regulate the marketing of vegetables for processing produced in the Province of Quebec in interprovincial and export trade.

Short Title

 This Order may be cited as the Quebec Vegetables for Processing Order.

Interpretation

 In this Order,

Board

Board means the Office des producteurs de fruits et légumes du Québec; (Office)

vegetables

vegetables means waxed beans, green beans, green peas, sweetcorn, cucumbers, asparagus and tomatoes produced in the Province of Quebec. (légumes)

Interprovincial and Export Trade

 The Board is authorized to regulate the marketing of vegetables for processing in interprovincial and export trade and for those purposes may, with respect to persons and property situated within the Province of Quebec, exercise all or any powers like the powers exercisable by the Commodity Board under An Act respecting the marketing of agriculture, food and fish products and amending various legislation, S.Q. 1990, c. 13, in relation to the marketing of vegetables grown for processing locally within that Province.

Levies or Charges

 The Board may, in relation to the powers granted to it under section 3,

  • (a) fix and impose, by order, levies or charges and collect the levies or charges from persons referred to in section 3 who are engaged in the production or marketing of vegetables for processing and, for those purposes, may classify those persons into groups and fix, by order, the levies or charges payable by the members of the different groups in different amounts; and

  • (b) use the levies or charges for the purposes of the Board, including the creation of reserves, the payment of expenses and losses resulting from the sale or disposal of vegetables for processing and the equalization or adjustment among the producers of vegetables for processing of moneys realized from the sale thereof during such period as the Board may determine.
