Regulations Respecting Zoning at Kindersley Airport

Whereas, pursuant to section 5.5 of the Aeronautics Act, a copy of the proposed Zoning Regulations respecting Kindersley Airport, substantially in the form set out in the schedule hereto, was published in two successive issues of the Canada Gazette Part I on December 15th and 22nd, 1990 and in two successive issues of the Kindersley Clarion on January 23rd and 30th, 1991, and a reasonable opportunity was thereby afforded to interested persons to make representations to the Minister of Transport with respect thereto;

Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to section 5.4 of the Aeronautics Act, is pleased hereby to make the annexed Regulations respecting zoning at Kindersley Airport.

Short Title

 These Regulations may be cited as the Kindersley Airport Zoning Regulations.

Interpretation

  •  (1) In these Regulations,

    airport

    airport means the Kindersley Airport, in the vicinity of Kindersley in the Province of Saskatchewan; (aéroport)

    airport reference point

    airport reference point means the point described in Part I of the schedule; (point de repère de l’aéroport)

    approach surface

    approach surface means an imaginary inclined plane that extends upward and outward from each end of a strip, which approach surface is more particularly described in Part II of the schedule; (surface d’approche)

    Minister

    Minister means the Minister of Transport; (ministre)

    outer surface

    outer surface means an imaginary surface located above and in the immediate vicinity of the airport, which outer surface is more particularly described in Part III of the schedule; (surface extérieure)

    strip

    strip means the rectangular portion of the landing area of the airport, including the runway, prepared for the take-off and landing of aircraft in a particular direction, which strip is more particularly described in Part IV of the schedule; (bande)

    transitional surface

    transitional surface means an imaginary inclined plane that extends upward and outward from the lateral limits of a strip and its approach surfaces, which transitional surface is more particularly described in Part V of the schedule. (surface de transition)

  • (2) For the purposes of these Regulations, the elevation of the airport reference point is 689.5 m above sea level.

Application

 These Regulations apply to all the lands, including public road allowances, adjacent to or in the vicinity of the airport, which lands are more particularly described in Part VI of the schedule.

General

 No person shall erect or construct on any land to which these Regulations apply, any building, structure or object or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at the location of that point

  • (a) the approach surfaces;

  • (b) the outer surface; or

  • (c) the transitional surfaces.

Natural Growth

 Where an object of natural growth on any land to which these Regulations apply exceeds in elevation any of the surfaces referred to in paragraphs 4(a) to (c), the Minister may require that the owner or occupier of the land on which that object is growing remove the excessive growth.

Disposal of Waste

 No owner or occupier of any land to which these Regulations apply shall permit such land or any part of it to be used for the disposal of any waste that is edible by or attractive to birds.

SCHEDULE(Sections 2 and 3)

PART IDescription of Airport Reference Point

The airport reference point shown on Kindersley Airport Zoning Plan No. E.2713 dated February 23, 1989, is a point located on the centre line of runway 07-25 distant 533.5 m from the end of runway 25.

PART IIDescription of the Approach Surfaces

The approach surfaces, shown on Kindersley Airport Zoning Plan No. E.2713 dated February 23, 1989, are surfaces abutting each end of the strip associated with the runway designated 07-25 and are described as follows:

  • (a) surface abutting the end of the strip associated with runway approach 07 consisting of an inclined plane having a ratio of 1 m measured vertically to 30 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 2 500 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 295.0 m from the projected centre line; said imaginary horizontal line being 83.3 m above the elevation at the end of the strip; and

  • (b) a surface abutting the end of the strip associated with runway approach 25 consisting of an inclined plane having a ratio of 1 m measured vertically to 30 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 2 500 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 295.0 m from the projected centre line; said imaginary horizontal line being 83.3 m above the elevation at the end of the strip.

PART IIIDescription of the Outer Surface

The outer surface, shown on Kindersley Airport Zoning Plan No. E.2713 dated February 23, 1989, is an imaginary surface located at a common plane established at a constant elevation of 45 m above the elevation of the airport reference point, except that, where that common plane is less than 9 m above the surface of the ground, the outer surface is an imaginary surface located at 9 m above the surface of the ground.

PART IVDescription of the Strip

The strip associated with runway 07-25 shown on Kindersley Airport Zoning Plan No. E.2713 dated February 23, 1989, is 90 m in width, 45 m being on each side of the centre line of the runway, and 1 187 m in length.

PART VDescription of Each Transitional Surface

Each transitional surface, shown on Kindersley Airport Zoning Plan No. E.2713 dated February 23, 1989, is a surface consisting of an inclined plane rising at a ratio of 1 m measured vertically to 7 m measured horizontally at right angles to the centre line and projected centre line of the strip extending upward and outward from the lateral limits of the strip and its approach surfaces to an intersection with the outer surface.

PART VIDescription of the Lands to Which These Regulations Apply

The boundary of the outer limits of lands, shown on Kindersley Airport Zoning Plan No. E.2713 dated February 23, 1989, is described as follows:

COMMENCING at the northeast corner of Section 35, Township 29, Range 23, West of the Third Meridian;

THENCE southerly along the easterly limits of Section 35 and Section 26, the northeast quarter of Section 23 and the intervening road allowance to the southeast corner of the northeast quarter of Section 23;

THENCE westerly along the southerly limit of the northeast quarter of Section 23 to the southwest corner of the northeast quarter of Section 23;

THENCE southerly along the easterly limit of the southwest quarter of Section 23 to the southeast corner of the southwest quarter of Section 23;

THENCE westerly along the southerly limit of the southwest quarter of Section 23 and across the intervening road allowance to the northeast corner of Section 15;

THENCE southerly along the easterly limit of the northeast quarter of Section 15 to the southeast corner of the northeast quarter of Section 15;

THENCE westerly along the southerly limits of the north half of Section 15, the north half of Section 16, the north half of Section 17 and the intervening road allowances to the southwest corner of the north half of Section 17;

THENCE northerly along the westerly limit of the northwest quarter of Section 17 to the northwest corner of Section 17;

THENCE westerly across the road allowance and along the southerly limit of the southeast quarter of Section 19 to the southwest corner of the southeast quarter of Section 19;

THENCE northerly along the westerly limit of the southeast quarter of Section 19 to the northwest corner of the southeast quarter of Section 19;

THENCE westerly along the southerly limit of the northwest quarter of Section 19 to the southwest corner of the northwest quarter of Section 19;

THENCE northerly along the westerly limits of the northwest corner of Section 19, Section 30, Section 31, the southwest quarter of Section 6, Township 30, Range 23, West of the Third Meridian and the intervening road allowances to the northwest corner of the southwest quarter of Section 6;

THENCE easterly along the northerly limit of the southwest quarter of Section 6 to the northeast corner of the southwest quarter of Section 6;

THENCE northerly along the westerly limit of the northeast quarter of Section 6 to the northwest corner of the northeast quarter of Section 6;

THENCE easterly along the northerly limit of the northeast quarter of Section 6 and across the road allowance to the southwest corner of Section 8;

THENCE northerly along the westerly limit of the southwest quarter of Section 8 to the northwest corner of the southwest quarter of Section 8;

THENCE easterly across the northerly limits of the south half of Section 8, the south half of Section 9, the south half of Section 10 and the intervening road allowances to the northeast corner of the southeast quarter of Section 10;

THENCE southerly along the easterly limit of the southeast quarter of Section 10 to the southeast corner of Section 10;

THENCE easterly across the road allowance and along the northerly limit of the northwest quarter of Section 2 to the northeast corner of the northwest quarter of Section 2;

THENCE southerly along the easterly limit of the northwest quarter of Section 2 to the northwest corner of the southeast quarter of Section 2;

THENCE easterly along the northerly limit of the said southeast quarter of Section 2 to the northeast corner of the southeast quarter of Section 2;

THENCE southerly along the easterly limit of the southeast quarter of Section 2 and across the road allowance to the point of commencement.
