Regulations Respecting the Registration of Lobbyists

His Excellency the Governor General in Council, on the recommendation of the Minister of Industry, pursuant to subsections 5(1) to (5)Footnote *, 6(1)* and (3) to (6)* and 7(1)* and (3) to (5)* and section 12Footnote ** of the Lobbyists Registration ActFootnote ***, is pleased hereby to repeal the Lobbyists Registration Regulations, made by Order in Council P.C. 1989-1664 of August 24, 1989Footnote ****, and to make the annexed Regulations respecting the registration of lobbyists in substitution therefor, effective January 31, 1996.

Short Title
1 These Regulations may be cited as the Lobbyists Registration Regulations.
Interpretation
2 In these Regulations,
- Act
Act means the Lobbyists Registration Act; (Loi)
- notice
notice means a written document informing the registrar of
(a) the completion or termination of an undertaking, in accordance with subsection 5(1.3) of the Act,
(b) any change to the information provided in a return, and any new information, the knowledge of which the individual acquired only after the return was filed, in accordance with subsection 5(3) of the Act,
(c) any clarification of information provided at the request of the registrar, pursuant to subsection 5(5) or 7(5) of the Act,
(d) the fact that an employee named in a return no longer performs any of the duties described in paragraph 7(1)(a) of the Act or is no longer employed by the employer, referred to in subsection 7(4) of the Act, or
(e) the fact that an employer no longer employs any employees who perform lobbying activities in accordance with paragraph 7(2.1)(b) of the Act; (avis)

registry means the registry established under subsection 9(1) of the Act; (registre)
- return
return means a return required by subsection 5(1) or 7(1) of the Act. (déclaration)

Filing of Returns, Notices and other Documents
3 A return or a notice shall be made in writing in paper format or in electronic format.
4 (1) A return referred to in subsection 5(1) of the Act, or a notice required pursuant to subsection 5(1.3), (3) or (5) of the Act, that is made in paper format shall be in Form 1 of the schedule.
(2) A return referred to in subsection 7(1) of the Act, or a notice required pursuant to paragraph 7(2.1)(b) or subsection 7(4) or (5) of the Act, that is made in paper format shall be in Form 2 of the schedule.

5 A return, notice or other document that is made in paper format shall be filed by
(a) sending it by mail to the office of the registrar; or
(b) delivering it by hand to the office of the registrar.
6 Where a return, notice or other document is filed by facsimile transmission or in any other electronic format, it is not necessary to file a copy of the return, notice or other document in paper format.
7 Where a notice or other document respecting a return is received in the office of the registrar, the registrar shall add to the record of the return
(a) the information contained in the notice or other document; and
(b) the date on which the notice or other document was received.
Deemed Date of Filing
8 A return, notice or other document that is sent to the registrar by facsimile transmission or in any other electronic format is deemed to be received by the registrar at the time indicated by the receiving apparatus.
