Pursuant to subsection 117(2) of the Canada Transportation ActFootnote a, the Canadian Transportation Agency hereby makes the Railway Traffic and Passenger Tariffs Regulations in accordance with the schedule hereto.

July 2, 1996

His Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to subsection 36(1) of the Canada Transportation ActFootnote a, hereby approves the annexed Railway Traffic and Passenger Tariffs Regulations, made by the Canadian Transportation Agency.

Interpretation

 The definitions in this section apply in these Regulations.

Act

Act means the Canada Transportation Act. (Loi)

electronic form

electronic form, in respect of the issuance and publication of a tariff, means a manner by which the tariff is made available for public inspection electronically. (forme électronique)

printed form

printed form, in respect of the issuance and publication of a tariff, means a book, pamphlet, single sheet or loose-leaf sheets. (forme imprimée)

Information to Be Included in Tariffs

 The following information shall be included in every traffic or passenger tariff that is issued and published by a railway company under Part III of the Act:

  • (a) a statement of the rates, in dollars and cents, for each designated unit of weight or volume, for each type of equipment or service rendered or for each passenger;

  • (b) a brief description of any category of traffic or passenger that is being transported;

  • (c) the point of origin and point of destination of any traffic or passenger;

  • (d) a description of the route over which a rate applies, or a reference to a routing guide to describe that route;

  • (e) the date of issuance, of coming into force and of expiration of the tariff;

  • (f) any terms and conditions of the tariff, including terms and conditions of the carriage of persons with disabilities, or an explanation, with references, of where the terms and conditions can be found; and

  • (g) an explanation of any symbols or abbreviations used in the tariff.

 In addition to maintaining the information specified in section 2, an amended tariff shall include the following information:

  • (a) any changes, highlighted, that are made to the tariff that was in effect immediately before the changes came into force;

  • (b) where a tariff is in printed form and any changes are found in a supplement to the tariff,

    • (i) a reference to any cancelled supplement and where it can be found, and

    • (ii) a list of any other supplements to the tariff that are in effect on the date of issuance of the supplement; and

  • (c) where a tariff is in electronic form, a reference to all previous versions of items that are being amended.
