Regulations Respecting the Hiring of Persons within Student Employment Programs

Whereas, pursuant to subsection 41(2) of the Public Service Employment Act, the Public Service Commission has, by decision dated March 6, 1997, recommended to the Minister of Canadian Heritage to recommend to the Governor in Council to revoke the Appointment of Students within the Federal Summer Student Employment Program Exclusion Approval Order made by Order in Council P.C. 1995-15 of January 11, 1995Footnote a;

Whereas, pursuant to subsection 37(1) of the Public Service Employment Act, the Public Service Commission, has, by decision dated March 6, 1997, recommended to the Governor in Council to revoke the Appointment of Students within the Federal Summer Student Employment Program Regulations made by Order in Council P.C. 1995-15 of January 11, 1995Footnote a;
Whereas, pursuant to subsection 41(1) of the Public Service Employment Act, the Public Service Commission has decided that it is not practicable nor in the best interests of the Public Service to apply the Public Service Employment Act, with the exception of subsections 16(4) and 17(4), to persons appointed on or after April 9, 1997 within Student Employment Programs and to positions to which these persons are appointed and has, subject to the approval of the Governor in Council, by decision dated March 6, 1997, excluded from the operation of the Public Service Employment Act, with the exception of subsections 16(4) and 17(4), the persons appointed on or after April 9, 1997 within Student Employment Programs and the positions to which these persons are appointed;
And Whereas, pursuant to subsection 37(1) of the Public Service Employment Act, the Public Service Commission recommends to the Governor in Council to make the annexed Regulations respecting the hiring of persons within Student Employment Programs;
Therefore, His Excellency The Governor General in Council,
(a) on the recommendation of the Minister of Canadian Heritage and pursuant to subsection 41(2) of the Public Service Employment Act, by decision made by the Public Service Commission on March 6, 1997, hereby revokes the Appointment of Students within the Federal Summer Student Employment Program Exclusion Approval Order made by Order in Council P.C. 1995-15 of January 11, 1995Footnote a;
(b) on the recommendation of the Minister of Canadian Heritage and the Public Service Commission and pursuant to subsection 37(1) of the Public Service Employment Act, by decision made by the Public Service Commission on March 6, 1997, hereby revokes the Appointment of Students within the Federal Summer Student Employment Program Regulations made by Order in Council P.C. 1995-15 of January 11, 1995Footnote a;
(c) on the recommendation of the Minister of Canadian Heritage and pursuant to subsection 41(1) of the Public Service Employment Act, hereby approves the exclusion made by the Public Service Commission on March 6, 1997 from the operation of the Public Service Employment Act, with the exception of subsections 16(4) and 17(4), of the persons appointed on or after April 9, 1997 within Student Employment Programs and of the positions to which these persons are appointed; and
(d) on the recommendation of the Minister of Canadian Heritage and the Public Service Commission and pursuant to subsection 37(1) of the Public Service Employment Act, hereby makes the annexed Regulations respecting the hiring of persons within Student Employment Programs.
Short Title
1 These Regulations may be cited as the Student Employment Programs Regulations.
Interpretation
2 In these Regulations,
- Commission
Commission means the Public Service Commission; (Commission)
- Student Employment Programs
Student Employment Programs means programs designated by the Treasury Board as Student Employment Programs. (programmes d’embauche des étudiants)
Application
3 These Regulations apply to persons appointed within Student Employment Programs and to the positions to which these persons are appointed.

General
4 Subject to the terms and conditions established by the Commission, the deputy head of a department may appoint a person within Student Employment Programs if, in the opinion of the deputy head, the person possesses the competencies required for the work to be performed.
5 A person appointed within Student Employment Programs is eligible to participate in closed competitions as defined in the Public Service Employment Act and for appointment from within the Public Service only when the following conditions are met:
(a) persons appointed within Student Employment Programs are specifically included in the area of selection determined for the closed competition being held;
(b) he or she meets the other criteria of the area of selection;
(c) he or she is able to demonstrate that he or she is capable of completing the post-secondary education program or, as the case may be, vocational training program in which he or she was registered at the time of his or her most recent appointment within Student Employment Programs, within the timeframe indicated on the competition notice.

5.1 A person selected in compliance with section 5 cannot be appointed from within the Public Service before successful completion of his or her post-secondary education program or, as the case may be, vocational training program.

5.2 A person who is appointed as a result of a closed competitive process shall be considered to be on probation from the date of the appointment until the end of such period as established by the Commission in the Public Service Employment Regulations.

6 The Commission and deputy heads may authorize persons under their respective jurisdiction to exercise any of the powers and functions granted to them pursuant to the present Regulations.
