An Act respecting the Hudson Bay Mining and Smelting Co., Limited
His Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
Marginal note:Works declared for the advantage of two or more provinces
1 It is hereby declared that the works and undertakings of Hudson Bay Mining and Smelting Co., Limited, in the Flin Flon mineral area on both sides of the boundary between Manitoba and Saskatchewan, are works for the advantage of two or more of the provinces.
Marginal note:Applicable safety and health legislation
2 (1) The provisions of the laws of Manitoba referred to in the schedule apply to the Hudson Bay Mining and Smelting Co., Limited and its employees in respect of employment on and in the works and undertakings referred to in section 1.
Marginal note:Amendment of schedule
(2) The Governor in Council may, by regulation, amend the schedule
(a) by adding thereto a reference to any Act of the Legislature of Manitoba or any regulation of the Lieutenant Governor in Council of Manitoba relating to the protection of safety or health;
(b) by adding thereto a reference to such an Act or regulation as amended to a specified date, or as amended from time to time; or
(c) by deleting any reference therefrom.

Marginal note:Offence and penalty
3 (1) Every person who, in doing anything or failing to do anything, contravenes any provision of a law of Manitoba referred to in the schedule in respect of employment described in subsection 2(1) is guilty of an offence against this Act and is liable to the same punishment as is imposed by or under any Act of the Legislature of Manitoba for an offence against that provision.

(2) The prosecution of an offence in respect of a provision referred to in subsection (1) shall be commenced by the Attorney General of Manitoba or an agent thereof and conducted in accordance with the laws of Manitoba applicable to the prosecution of offences against that provision.

(3) The proceeds of any fine imposed in proceedings under this section, or of any recognizance forfeited in such proceedings, belong to Her Majesty in right of Manitoba and shall be paid to the Treasurer of Manitoba

4 The provisions of the Canada Labour Code relating to occupational safety and health do not apply to the Hudson Bay Mining and Smelting Co., Limited or its employees in respect of employment described in subsection 2(1)

5 Nothing in this Act affects the operation of any Act of a province in relation to compensation for injuries sustained or industrial diseases contracted by workers in the course of their employment.
