PUBLIC SERVICE PENSION ADJUSTMENT ACT

Regulations Made Pursuant to the Public Service Pension Adjustment Act

Short Title

 These Regulations may be cited as the Public Service Pension Adjustment Regulations.

Interpretation

 In these Regulations,

Act

Act means the Public Service Pension Adjustment Act; (Loi)

re-employed recipient

re-employed recipient means a recipient who holds any office or position or performs any services, the remuneration for which is payable out of the Consolidated Revenue Fund or by an agent of Her Majesty in right of Canada. (bénéficiaire employé de nouveau)

General

 The increase in the pension payable to a re-employed recipient pursuant to the Act shall be suspended where, under the enactment or pension plan pursuant to which the pension is payable, the pension of the recipient is suspended in whole or in part.

 Where, under the enactment or pension plan pursuant to which the pension of a re-employed recipient is payable, no part of the pension of the recipient is suspended, the increase in the pension payable to the recipient pursuant to the Act shall be paid to the extent that it would be payable if the increase were part of the pension payable to the recipient under the said enactment or pension plan.
