Regulations Under the Trade Unions Act
Short Title
1 These Regulations may be cited as the Trade Unions Regulations.
Interpretation
2 In these Regulations,
- Act
Act means the Trade Unions Act; (Loi)
- complete alteration of rules
complete alteration of rules means the substitution of an entire set of rules for the registered rules of a trade union; (modification intégrale du règlement)
- partial alteration of rules
partial alteration of rules means the addition of one or more new rules to the registered rules of a trade union or the substitution of one or more new rules for any of such registered rules. (modification partielle du règlement)
Application for Registration
3 (1) An application for the registration of a trade union shall be in Form 1 of the schedule.
(2) The general statement of receipts, funds, effects and expenditures of a registered trade union required by section 13 of the Act shall be in Form 2 of the schedule.
(3) The copy of the new rules and alterations of rules required by section 14 of the Act shall be in Form 3 of the schedule.
(4) The statement showing the changes of officers made by a trade union required by section 14 of the Act shall be in Form 4 of the schedule.
4 Upon receiving an application for the registration of a trade union that is already in operation, the Registrar, if he has reason to believe that the applicants have not been duly authorized by the trade union to make the application, may, for the purpose of ascertaining the fact, require from the applicants such evidence as he deems necessary.
Certificate of Registry
5 The certificate of registry shall be delivered to the applicants on payment of $4.
6 Documents transmitted to the Registrar relating to a registered trade union may be inspected by any person on payment of a fee of $0.25.
7 (1) Where
(a) a trade union ceases to be a trade union as defined in section 2 of the Act, or
(b) the registration of a trade union is void under section 6 of the Act,
the Registrar may cancel the certificate of registry of such trade union.
(2) At least two months before cancelling a certificate of registry under paragraph (1)(a), the Registrar shall send by registered mail a notice to the trade union at its last known address setting out briefly the grounds for the proposed cancellation of its certificate of registry.
(3) At the request of a trade union, evidenced in such manner as the Registrar may request, the Registrar may withdraw its certificate of registry.
Partial Alteration of Rules
8 (1) An application for registry of a partial alteration of rules shall be in Form 6 of the schedule and shall be accompanied by
(a) a declaration in Form 5 of the schedule;
(b) two copies, marked “O”, of the new rules proposed to be added or substituted; and
(c) one copy of the old rules proposed to be replaced.
(2) The Registrar shall not register a partial alteration of rules unless the rules of the trade union, if altered as proposed, meet all the requirements of the Act respecting rules of a registered trade union.
(3) Upon registering a partial alteration of rules, the Registrar shall issue a Certificate of Registry of Partial Alteration of Rules in Form 8 of the schedule, and shall, on receipt of a fee of $2, deliver it to the applicant and attach thereto one copy of the new rules that were added or substituted.

Complete Alteration of Rules
9 (1) An application for registry of a complete alteration of rules shall be in Form 7 of the schedule and shall be accompanied by
(a) a declaration in Form 5 of the schedule;
(b) two copies, marked “P”, of the new set of rules.
(2) The Registrar shall not register a complete alteration of rules unless the rules, if altered as proposed, meet all the requirements of the Act respecting rules of a registered trade union.
(3) Upon registering a complete alteration of rules, the Registrar shall issue a Certificate of Registry of Complete Alteration of Rules in Form 9 of the schedule, and shall, on receipt of a fee of $2, deliver it to the applicant and attach thereto one copy of the new set of rules.

10 The provisions for the investment of funds and for the periodical audit of accounts is set forth in rule No
11 The provision for the inspection of the books and names of the members by every person having an interest in the funds is set forth in rule No
12 Accompanying this application are sent:
(1) Two copies, each marked “A”, of the rules.
(2) A list, marked “B”, of the titles and names of the officers.
(3) A general statement, marked “C”Footnote *, showing
(a) the assets and liabilities of theFootnote † at the date up to which the statement is made out;
(b) the receipts and expenditures ofFootnote † during the year preceding the date Footnote § up to which the statement is made out, such expenditure being set forth under separate heads corresponding to the several objects of the trade union.

In paragraph 13 must be stated whether the authority to make this application was given by “a resolution of a general meeting of the trade union”, or if not, in what other way it was given.
The two copies of rules must be signed by seven members signing this application.
The application should be dated, and forwarded to “The Registrar-General of Canada, Ottawa.”
