Order Respecting the Withdrawal from Disposal of Certain Lands in the Northwest Territories

Whereas the Governor in Council is of the opinion that the lands described in the annexed Order are required to facilitate the settlement of native land claims;
Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Indian Affairs and Northern Development, pursuant to paragraph 23(a) of the Territorial Lands Act, is pleased hereby to make the annexed Order respecting the withdrawal from disposal of certain lands in the Northwest Territories.
Short Title
1 This Order may be cited as the Withdrawal from Disposal Order (Contwoyto Lake, N.W.T.).
Purpose
2 The purpose of this Order is to withdraw from disposal certain lands required for the settlement of native land claims.
Lands Withdrawn
3 The lands described in the Schedule are withdrawn from disposal under the Territorial Lands Act for the period terminating on May 31, 1995 or registration of the survey plan in the Land Titles Office and the issuance of Certificates of Title, whichever comes first.
Application
4 Section 3 does not apply to
(a) located or recorded mineral claims or prospecting permits in good standing under the Canada Mining Regulations;
(b) the right to obtain a surface lease on located or recorded mineral claims, pursuant to the Territorial Lands Regulations;
(c) rights in good standing created pursuant to section 8 of the Territorial Lands Act or the Territorial Lands Regulations;
(d) permits, special renewal permits and leases in good standing under the Canada Oil and Gas Land Regulations;
(e) permits in good standing under the Territorial Quarrying Regulations;
(f) existing rights and interests granted pursuant to the Canada Petroleum Resources Act;
(g) existing rights issued pursuant to the Territorial Coal Regulations and the Territorial Dredging Regulations; and
(h) interests in lands described in “Exhibit 2” to the Acquisition Agreement dated May 5, 1988 among Her Majesty in right of Canada, the Northern Canada Power Commission, the Government of the Northwest Territories and the Northwest Territories Power Corporation.
