Order Transferring from the Minister of Finance, to the Minister of National Health and Welfare and to the Minister of Employment and Immigration Certain Powers, Duties and Functions with Respect to Certain Programs

His Excellency the Governor General in Council, on the recommendation of the Prime Minister, pursuant to paragraph 2(a) of the Public Service Rearrangement and Transfer of Duties Act, is pleased hereby to transfer
(a) to the Minister of National Health and Welfare the powers, duties and functions of the Minister of Finance under subsection 23.1(1) of the Federal-Provincial Fiscal Arrangements and Federal Post-Secondary Education and Health Contributions Act (the Act) for making a special adjustment payment to each province, in an amount that is a portion of the amount determined, by the Minister of Finance, in accordance with subsections 23.1(2) and (3) of the Act, which portion shall be the sum of the amounts, in respect of both of the insured health services program and the extended health care services program, that bear the same proportion to the amount of the total special adjustment payment to all provinces under section 23.1 of the Act as the sum of the amount of the total entitlement of all provinces in respect of the insured health services program, as determined by subsection 15(1) of the Act, and the amount payable to the provinces in respect of the extended health care services program pursuant to subsection 23(2) of the Act bears to the sum of the amounts of the entitlements of all provinces, as determined by subsections 15(1) and (2) of the Act, and the amounts payable to the provinces pursuant to subsection 23(2) of the Act; and
(b) to the Minister of Employment and Immigration the powers, duties and functions of the Minister of Finance under subsection 23.1(1) of the Act for making a special adjustment payment to each province, in an amount that is a portion of the amount determined, by the Minister of Finance, in accordance with subsections 23.1(2) and (3) of the Act, which portion shall be an amount, in respect of the post-secondary education financing program, that bears the same proportion to the amount of the total special adjustment payment to all provinces under section 23.1 of the Act as the sum of the amounts of the entitlements of all provinces in respect of the post-secondary education financing program, as determined by subsection 15(2) of the Act, bears to the sum of the amounts of the entitlements of all provinces, as determined by subsections 15(1) and (2) of the Act, and the amounts payable to the provinces pursuant to subsection 23(2) of the Act.
