Withdrawal from Disposal Order (Wager Bay National Park, N.W.T.) (SI/96-87)

SCHEDULE(Sections 3 and 4)Lands Withdrawn from Disposal

In the Northwest Territories encompassing all those lands which drain into Wager Bay, more particularly described with reference to the second edition of the National Topographic Series maps 46E, 56F, 56I, 56J, 56K, third edition of map 56G, and fourth edition of map 56H produced at a scale of 1:250,000 by the Department of Energy, Mines and Resources. All coordinates are derived from the above mentioned map sheets being referred to the 1927 Datum.

All those lands which drain into Wager Bay, and certain adjacent lands in the vicinity of Roes Welcome Sound, and all islands within Wager Bay, more properly described as follows:

Commencing at a point on the western shoreline of Roes Welcome Sound, at the intersection of the ordinary low water mark and latitude 65°30′N, at approximate longitude 87°01′W;

thence west in a straight line to a point at latitude 65°30′N and longitude 87°45′W;

thence northerly in a straight line to the south shore of an unnamed lake at approximate latitude 65°46′N and longitude 87°45′W;

thence northwesterly in a straight line to a height of land at approximate latitude 65°57′N and approximate longitude 88°21′W;

thence northerly in a straight line to a height of land at approximate latitude 66°34′N and approximate longitude 88°34′W;

thence southwesterly in a straight line to a height of land at approximate latitude 66°14′N and approximate longitude 89°30′W;

thence northwesterly in a straight line to a height of land at approximate latitude 66°33′N and approximate longitude 90°37′W;

thence southwesterly in a straight line to a height of land at approximate latitude 66°20′N and approximate longitude 91°06′W;

thence northwesterly in a straight line to a height of land at approximate latitude 66°29′N and approximate longitude 91°47′W;

thence westerly in a straight line to a height of land at approximate latitude 66°30′N and approximate longitude 92°27′W;

thence southwesterly in a straight line to a height of land (locally called Quartzite Ridge) at approximate latitude 66°18′N and approximate longitude 93°07′W;

thence southeasterly in a straight line to a height of land at approximate latitude 65°56′N and approximate longitude 92°15′W;

thence southerly in a straight line to latitude 65°20′N and longitude 90°00′W;

thence south in a straight line to latitude 65°00′N and longitude 90°00′W;

thence east in a straight line to its intersection with the ordinary low water mark of the shoreline of Roes Welcome Sound, at approximate longitude 87°04′W;

thence northerly, following the sinuousities of the ordinary low water mark of the west shoreline of Roes Welcome Sound, to Cape Dobbs;

thence generally westerly, northwesterly, easterly, southeasterly and northerly, following the sinuousities of the ordinary low water mark of the shorelines of Wager Bay and Roes Welcome Sound, to the point of commencement;

and including therein all islands at low water within Wager Bay;

said parcel containing approximately 23,570 square kilometres.

Saving and excepting therefrom and reserving thereout Inuit Owned Lands Parcels RE31/56H, RE32/56H and RE87/56I, J (surface title only) shown on Inuit Owned Lands Ownership Map No. 133 in the series numbered 1 to 237, that were jointly delivered to the Registrar of Land Titles in the Northwest Territories on the 15th day of April 1993, except when the description shown by the relevant map is replaced by that shown by a descriptive map plan or plan of survey in accordance with the Agreement Between the Inuit of the Nunavut Settlement Area and Her Majesty the Queen in right of Canada signed on May 25, 1993, in which case the Parcels are shown on the replacement plan;

Saving and excepting therefrom and reserving thereout all those lands included under Lease 56H/14-2-2, Sila Lodge; and lease 56H/14-1-2; Government of the Northwest Territories Reserve 56H/10-1 and Environment Canada Reserve 56J/4-1, all on file at the office of the Regional Manager, Land Resources Division, Northwest Territories;

Saving and excepting therefrom and reserving thereout any tract of territorial lands described in the schedule which is subject to an agreement for lease or sale made pursuant to the Territorial Lands Act and the Territorial Lands Regulations;

Including all mines and minerals, including hydrocarbons, whether solid, liquid or gaseous, and rights to work the same;

Including any substances or materials that may be disposed of pursuant to the Territorial Quarrying Regulations; and

Including timber that may be disposed of pursuant to the Forest Management Act of the Northwest Territories.
