Regulations Respecting Zoning at Boundary Bay Airport

His Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to section 6Footnote * of the Aeronautics Act, is pleased hereby to approve the annexed Regulations respecting zoning at Boundary Bay Airport made by the Minister of Transport.

Short Title

 These Regulations may be cited as the Boundary Bay Airport Zoning Regulations.

Interpretation

  •  (1) In these Regulations,

    airport

    airport means the Boundary Bay Airport, in the municipality of Delta, in the Province of British Columbia; (aéroport)

    airport reference point

    airport reference point means the point described in Part I of the schedule; (point de repère de l’aéroport)

    approach surface

    approach surface means an imaginary inclined plane that extends upward and outward from each end of a strip, which approach surface is more particularly described in Part III of the schedule; (surface d’approche)

    Minister

    Minister means the Minister of Transport; (ministre)

    outer surface

    outer surface means an imaginary surface located above and in the immediate vicinity of the airport, which outer surface is more particularly described in Part IV of the schedule; (surface extérieure)

    strip

    strip means the rectangular portion of the landing area of the airport including the runway prepared for the take-off and landing of aircraft in a particular direction, which strip is more particularly described in Part V of the schedule; (bande)

    transitional surface

    transitional surface means an imaginary inclined plane that extends upward and outward from the lateral limits of a strip and its approach surfaces, which transitional surface is more particularly described in Part VI of the schedule. (surface de transition)

  • (2) For the purposes of these Regulations, the assigned elevation of the airport reference point is 1.5 metres above sea level.

Application

 These Regulations apply to all the lands, including public road allowances, adjacent to or in the vicinity of the airport, that consist of

  • (a) the lands within, and

  • (b) the lands directly under that portion of an approach surface that extends beyond

the outer limits described in Part II of the schedule.

General

 No person shall erect or construct on any land to which these Regulations apply, any building structure or object or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at the location of that point, any

  • (a) approach surface;

  • (b) outer surface; or

  • (c) transitional surface.

Natural Growth

 Where an object of natural growth on any land to which these Regulations apply exceeds in elevation any of the surfaces referred to in section 4, the Minister may make a direction that the owner or occupier of the land on which that object is growing remove the excessive growth.

Disposal of Waste

 No owner or occupier of any land to which these Regulations apply shall permit that land or any part of it to be used for the disposal or accumulation of any waste, material or substance edible by or attractive to birds.

PART IDescription of the Airport Reference Point

The airport reference point is a point distant 385 metres measured northeastwardly from and at right angles to the centre line of runway 12-30 from a point thereon distant 70 metres measured northwestwardly along the said centre line from the southeasterly end of said runway.

PART IIDescription of the Outer Limits of Lands

The following described boundaries are the outer limits of lands:

Commencing at a point on the westerly boundary of 80th Street, said point lying northwardly and distant 450 metres from the intersection of the said westerly boundary of 80th Street and the southerly boundary of Parcel D, Explanatory Plan 2515, of District Lot 437, Group 2, New Westminster District; THENCE southeastwardly and in a straight line to the northeasterly corner of Lot 9, Plan 38013 of Sections 5 and 6, Township 4, New Westminster District; THENCE eastwardly across 88th Street to the northwesterly corner of the Northwest Quarter Section 4, Township 4; THENCE, northeastwardly, and in a straight line to the point of commencement, which boundary is shown outlined yellow on Department of Transport Plan No. B.C. 1266, sheets 1 to 24 inclusive, dated January 14th, 1980.

PART IIIDescription of the Approach Surfaces

The approach surfaces, shown outlined in blue on the Department of Transport Plan B.C. 1266, dated January 14, 1980, are surfaces abutting each end of the strips associated with the runways designated 07-25, 07R-25L and 12-30 and are described as follows:

  • (a) a surface abutting the end of the strip associated with runway approach 07 consisting of an inclined plane having a ratio of one metre measured vertically to 50 metres measured horizontally, rising to an intersection with the outer surface, thence said approach surface shall be horizontal and contiguous to said outer surface to an intersection with the western extremity of said outer surface, thence said approach surface shall slope upward at the above specified slope of one metre measured vertically to 50 metres measured horizontally, rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15 000 metres measured horizontally from the end of the strip, the outer ends of the imaginary horizontal line being 2 400 metres from the projected centre line, said imaginary horizontal line being 290.6 metres, measured vertically, above the airport reference point;

  • (b) a surface abutting the end of the strip associated with runway approach 25 consisting of an inclined plane having a ratio of one metre measured vertically to 50 metres measured horizontally, rising to an intersection with the outer surface, thence said approach surface shall be horizontal and contiguous to said outer surface to an intersection with the eastern extremity of said outer surface, thence said approach surface shall slope upward at the above specified slope of one metre measured vertically to 50 metres measured horizontally, rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 15 000 metres measured horizontally from the end of the strip, the outer ends of the imaginary horizontal line being 2 400 metres from the projected centre line, said imaginary horizontal line being 280.8 metres, measured vertically, above the airport reference point;

  • (c) a surface abutting the end of the strip associated with runway approach 07R consisting of an inclined plane having a ratio of one metre measured vertically to 40 metres measured horizontally, rising to an intersection with the outer surface, thence said approach surface shall be horizontal and contiguous to said outer surface to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 3 000 metres measured horizontally from the end of the strip, the outer ends of the imaginary horizontal line being 375 metres from the projected centre line, said imaginary horizontal line being 45 metres, measured vertically, above the airport reference point;

  • (d) a surface abutting the end of the strip associated with runway approach 25L consisting of an inclined plane having a ratio of one metre measured vertically to 40 metres measured horizontally, rising to an intersection with the outer surface, thence said approach surface shall be horizontal and contiguous to said outer surface to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 3 000 metres measured horizontally from the end of the strip, the outer ends of the imaginary horizontal line being 375 metres from the projected centre line, said imaginary horizontal line being 45 metres, measured vertically, above the airport reference point;

  • (e) a surface abutting the end of the strip associated with runway approach 12 consisting of an inclined plane having a ratio of one metre measured vertically to 40 metres measured horizontally, rising to an intersection with the outer surface, thence said approach surface shall be horizontal and contiguous to said outer surface to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 3 000 metres measured horizontally from the end of the strip, the outer ends of the imaginary horizontal line being 375 metres from the projected centre line, said imaginary horizontal line being 45 metres, measured vertically, above the airport reference point; and

  • (f) a surface abutting the end of the strip associated with runway approach 30 consisting of an inclined plane having a ratio of one metre measured vertically to 40 metres measured horizontally, rising to an intersection with the outer surface, thence said approach surface shall be horizontal and contiguous to said outer surface to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 3 000 metres measured horizontally from the end of the strip, the outer ends of the imaginary horizontal line being 375 metres from the projected centre line, said imaginary horizontal line being 45 metres, measured vertically, above the airport reference point.

PART IVDescription of the Outer Surface

The outer surface, shown outlined in yellow on the Department of Transport Plan No. B.C. 1266, dated January 14, 1980, is an imaginary surface located at a common plane established at a constant elevation of 45 metres above the assigned elevation of the airport reference point except where that common plane is less than nine metres above the surface of the ground, the imaginary surface is located at nine metres above the surface of the ground.

PART VDescription of the Strips

The strips, shown outlined in green on the Department of Transport Plan No. B.C. 1266, dated January 14, 1980, are described as follows:

  • (a) the strip associated with runway 07-25 is 300 metres in width, 150 metres being on each side of the centre line of the runway and 1 650 metres in length;

  • (b) the strip associated with runway 07R-25L is 150 metres in width, 75 metres being on each side of the centre line of the runway and 1 190 metres in length; and

  • (c) the strip associated with runway 12-30 is 150 metres in width, 75 metres being on each side of the centre line of the runway and 1 190 metres in length.

PART VIDescription of Each Transitional Surface

Each transitional surface, shown on the Department of Transport Plan No. B.C. 1266, dated January 14, 1980, is a surface consisting of an inclined plane having a ratio of one metre measured vertically to seven metres horizontally at right angles to the centre line and centre line produced of each strip and extending upward and outward rising from the lateral limits of each strip and its approach surfaces to an intersection with the outer surface or another transitional surface of an adjoining strip.
