Les Collections Shan Remission Order, 1997

His Excellency the Governor General in Council, on the recommendation of the Minister of Finance, pursuant to section 101 of the Customs TariffFootnote a, hereby makes the annexed Les Collections Shan Remission Order, 1997.

Remission

 In this Order,

co-ordinated beachwear and co-ordinated accessories

co-ordinated beachwear and co-ordinated accessories includes dresses, skirts, pants, shorts, cover-ups, wraps, handbags and other accessories manufactured in the same prints or in matching colours as those used to produce the swimsuits with which they are to be sold; (vêtements de plage coordonnés et accessoires coordonnés)

knitted fabrics

knitted fabrics means knitted fabrics of subheading No. 6002.30, 6002.42 or 6002.43 or of tariff item No. 6002.92.90 or 6002.93.00; (étoffes de bonneterie)

narrow woven fabrics

narrow woven fabrics means narrow woven fabrics of heading No. 58.06; (rubanerie)

nonwovens

nonwovens means nonwovens of subheading No. 5603.92, 5603.93 or 5603.94; (nontissés)

padding

padding means padding of tariff item No. 5903.20.20 or 5906.91.20; (bourrage)

textile products

textile products means knitted fabrics, narrow woven fabrics, nonwovens, padding, tulles, woven fabrics of cotton or woven fabrics of man-made filaments and man-made staple fibres, excluding fabrics of a uniform solid colour of black or white; (produits textiles)

tulles

tulles means tulles of heading No. 58.04; (tulles)

woven fabrics of cotton

woven fabrics of cotton means woven fabrics of cotton of subheading No. 5208.31, 5208.32, 5208.33, 5208.39, 5208.41, 5208.42, 5208.43, 5208.49, 5208.51, 5208.52, 5208.53, 5208.59, 5210.31, 5210.32, 5210.39, 5210.41, 5210.42, 5210.49, 5210.51, 5210.52, 5210.59, 5212.13, 5212.14, 5212.15, 5212.23, 5212.24 or 5212.25; (tissus de coton)

woven fabrics of man-made filaments and man-made staple fibres

woven fabrics of man-made filaments and man-made staple fibres means woven fabrics of man-made filaments and man-made staple fibres of subheading No. 5407.10, 5407.42, 5407.43, 5407.44, 5407.52, 5407.53, 5407.54, 5407.61, 5407.69, 5407.72, 5407.73, 5407.74, 5407.82, 5407.83, 5407.84, 5407.92, 5407.93, 5407.94, 5408.22, 5408.23, 5408.24, 5408.32, 5408.33 or 5408.34 or of heading No. 55.12, 55.13, 55.14, 55.15 or 55.16; (tissus de filaments synthétiques ou artificiels et de fibres synthétiques ou artificielles discontinues)

Conditions

 Subject to section 3, remission is hereby granted to Les Collections Shan Inc., Laval, Quebec, of the customs duties paid or payable under Schedule I to the Customs Tariff on the textile products set out in column I of the schedule to this Order up to the annual quantity limit shown opposite that textile product in column II for the five year period set out therein.

 Remission is granted on condition that:

  • (a) the textile products are used by Les Collections Shan Inc. in the manufacture of women’s swimsuits with the Shan label;

  • (b) the textile products that are imported by Les Collections Shan Inc. for use in the manufacture of women’s co-ordinated beachwear and co-ordinated accessories with the Shan label have a similar or complementary pattern and colour to the textile products used by Shan in the manufacture of women’s swimsuits and are made by the same supplier; and

  • (c) a claim for remission is made to the Minister of National Revenue within two years of the date of importation.

Coming into Force

 This Order comes into force on November 20, 1997.
