Firearms Fees Regulations

Whereas, pursuant to section 118 of the Firearms ActFootnote a, the Minister of Justice had the proposed Firearms Fees Regulations, substantially in the annexed form, laid before each House of Parliament on November 27, 1996 and October 30, 1997, which dates are at least 30 sitting days before the date of this Order;

Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Justice, pursuant to paragraphs 117(p) and (q) of the Firearms Acta, hereby makes the annexed Firearms Fees Regulations.

Interpretation

 The definitions in this section apply in these Regulations.

Act

Act means the Firearms Act. (Loi)

non-restricted firearm

non-restricted firearm means a firearm other than a prohibited firearm or a restricted firearm. (arme à feu sans restrictions)

PART 1Individuals

Fees Payable for Licences

 Subject to sections 2.1 to 6, the fee payable by an individual for the issuance or renewal, as the case may be, of a licence referred to in column 1 of Schedule 1 is the appropriate fee set out in column 2.

 If a possession and acquisition licence is issued for more than one class of firearm, the fee payable is the greatest of the appropriate fees set out in item 4 of Schedule 1.

Reduction and Waiver of Fees

  •  (1) Despite section 3, the fee payable by an individual for the renewal of a possession licence that is solely for non-restricted firearms or for the issuance or renewal of a possession and acquisition license that is solely for non-restricted firearms is waived for the period specified in subsection (4) if the individual had been issued, on or after December 1, 1998, a possession licence for firearms (other than a possession licence for firearms for individuals who are less than 18 years old) or a possession and acquisition licence for firearms.

  • (2) Subsection (1) does not apply in respect of a fee payable by an individual for a licence if the licence previously held by the individual had been revoked in circumstances other than those described in subsection 72(1.1) of the Act and that revocation had not been cancelled.

  • (3) The fee payable for the renewal of a possession licence for firearms for individuals who are less than 18 years old is waived for the period specified in subsection (4).

  • (4) For the purposes of subsections (1) and (3), the period begins on September 18, 2012 and ends on May 16, 2013.

 If an individual has held a possession licence for firearms for three years or less and that individual makes an application for a possession and acquisition licence for firearms, the fee payable for that licence is reduced by 50%.

 If an individual has held a possession and acquisition licence that is solely for non-restricted firearms for three years or less and that individual makes an application for a possession and acquisition licence for restricted or prohibited firearms, the fee payable for that licence is reduced by 50%.

 The fee payable for the issuance or renewal of a possession licence for firearms for individuals who are less than 18 years old is waived in respect of an individual who is eligible to hold the licence under subsection 8(2) of the Act.

 The fee payable for renewal of a possession licence that is solely for non-restricted firearms, or for issuance or renewal of a possession and acquisition licence that is solely for non-restricted firearms, is waived in respect of individuals who require firearms to hunt or trap in order to sustain themselves or their families.

PART 2Businesses

Fees Payable for Licences

  •  (1) Subject to subsection (2), the fee payable by a business for the issuance or renewal of a licence to carry on an activity referred to in column 1 of Schedule 2 is the appropriate fee set out in column 2.

  • (2) If there are two or more activities described in column 1 of Schedule 2 that are carried on by a business in the same place, the fee payable by the business for the issuance or renewal of a licence to carry on those activities is the greatest of the appropriate fees set out in column 2 for those activities.

Waiver of Fees

 If the sole activity of a business consists of the wholesale selling and manufacturing of ammunition, the fee payable by that business for a licence to carry on that activity is waived, provided that any factory or magazine that it uses for that activity is a licensed factory or magazine within the meaning of section 2 of the Explosives Act.

PART 3Authorizations and Confirmations

Fees Payable for Authorizations and Confirmations

 Subject to section 17, the fee payable for the issuance or renewal, as the case may be, of an authorization or a confirmation referred to in column 1 of Schedule 3 is the appropriate fee set out in column 2.

Waiver of Fees

 If an individual has paid a fee for an authorization to carry for use in connection with a lawful profession or occupation for a period of one year or less and, within 12 months after its issuance, requests any other authorization to carry for that use, the fee payable for that other authorization is waived.

PART 4General

Replacement

  •  (1) Subject to subsections (2) and (3), the replacement fee for a lost, stolen or destroyed licence, including any document referred to in subsection 120(4) of the Act, or for a lost, stolen or destroyed authorization or confirmation, is $25.

  • (2) The replacement fee for a lost, stolen or destroyed authorization to import or to export is waived.

  • (3) The replacement fee for a lost, stolen or destroyed possession licence for firearms for individuals who are less than 18 years old is $10.

  • (4) Subject to subsection (5), the replacement fee for lost, stolen or destroyed registration certificates is $10 for each set of four or fewer certificates replaced at the same time.

  • (5) The replacement fee for a lost, stolen or destroyed registration certificate for a non-restricted firearm or for a licence referred to in section 6 is waived in respect of individuals who require firearms to hunt or trap in order to sustain themselves or their families.
